Re: Request for Written Consent to Sublease Leased Premises

Dear ________,

I write in my capacity as your lessee under the Contract of Lease we executed, and respectfully request your prior written consent to sublease the leased premises, in accordance with Article 1650 of the Civil Code of the Philippines (Republic Act No. 386), which provides that the lessee may sublet the thing leased, in whole or in part, when the contract of lease does not contain an express prohibition against subleasing.

§ 1. The Leased Premises. The property subject of this request is that certain property more particularly described as follows:

§ 2. The Existing Lease. You will recall that we entered into a Contract of Lease which commenced on ________ and is to expire on ________, at a monthly rental of ________ (the “Lease”). A true and faithful copy of the said Lease is attached hereto and made an integral part of this letter. I respectfully confirm that the Lease contains no express prohibition against subleasing.

§ 3. Proposed Term of the Sublease. Owing to ________, I am unable to continue in personal possession of the premises. Accordingly, I intend for the property to be subleased for a period commencing on ________ and ending on ________, which period shall in no case extend beyond the term of the existing Lease.

§ 4. The Proposed Sublessee. I am pleased to inform you that I have a qualified prospective sublessee, namely ________, of legal age, with residence and postal address at ________. I respectfully submit that the said person will be a responsible and suitable occupant for the following reasons:

§ 5. Continuing Liability of the Lessee. Should you grant your consent, I expressly undertake and warrant the following:
