RE: REQUEST FOR INFORMATION UNDER THE FREEDOM OF INFORMATION ACT 2000

§ 1. I write to make a request for information to ________ (the "Public Authority") pursuant to section 1 of the Freedom of Information Act 2000 (the "Act"). This letter constitutes a request in writing within the meaning of section 8 of the Act.

§ 2. For the purposes of section 8(1)(b) of the Act, my name and an address for correspondence are stated at the head of this letter.

§ 3. I request that you provide me with the following recorded information held by the Public Authority:

§ 5. Statutory basis of this request. In support of and to assist with the prompt handling of this request, I respectfully draw your attention to the following provisions of the Act:

  • § 5.1. Under section 1(1) of the Act, I am entitled to be informed in writing whether the Public Authority holds the information described above and, if so, to have that information communicated to me, subject to any applicable exemptions in Part II of the Act.
  • § 5.2. Under section 10(1) of the Act, the Public Authority is required to comply with this request promptly and in any event not later than the twentieth working day following the date of its receipt.

§ 6. Fees. If you anticipate that a fee will be payable in accordance with section 9 of the Act and the Freedom of Information and Data Protection (Appropriate Limit and Fees) Regulations 2004, please provide a fees notice setting out the amount and basis of the proposed charge before incurring any cost, so that I may consider how I wish to proceed.

§ 7. Exemptions and partial disclosure. Should you consider that any part of the requested information is exempt from disclosure, I would be grateful if you would identify the specific exemption(s) relied upon, explain the reasons for their application (including, where relevant, the outcome of any public interest test under section 2 of the Act), and disclose any remaining information that is not subject to exemption.

§ 8. Internal review and complaints. If you are unable to comply with this request in whole or in part, please advise me of the Public Authority's internal review procedure under section 17 of the Act. I note my right, in the event of dissatisfaction with your response, to request an internal review and thereafter to apply to the Information Commissioner under section 50 of the Act.

§ 9. Acknowledgement. I should be grateful if you would acknowledge receipt of this request at your earliest convenience and confirm the date by which I may expect a substantive response. If you are unable to provide the requested information within the statutory period, please inform me as soon as possible, stating the reasons and the date by which the information is expected to be provided.
