RE: REQUEST FOR THE RETURN OF TENANCY DEPOSIT

Property: ________ (the “Property”)

§1. I write further to the assured shorthold tenancy of the Property granted to me by you under a tenancy agreement dated ________ (the “Tenancy Agreement”), which commenced on ________ and ended on ________.

§2. At the commencement of the tenancy I paid to you, or to your agent, a tenancy deposit in the sum of £________ (________) (the “Deposit”).

§3. I understand that the Deposit is, or ought to be, protected in the following Government-authorised tenancy deposit protection scheme pursuant to sections 212 to 215 of the Housing Act 2004: ________, under reference number ________.

§4. The Property was vacated on ________, on which date all keys to the Property were returned to you, or to your agent, and vacant possession was duly given up.

§5. I confirm that all of my obligations under the Tenancy Agreement have been fully performed. In particular, and without limitation:

1. no rent or other sums payable under the Tenancy Agreement remain outstanding;
2. no damage, beyond fair wear and tear within the meaning of that term as ordinarily applied to assured shorthold tenancies, has been caused to the Property, its fixtures, fittings or contents; and
3. the Property has been left in a clean and tidy condition, consistent with the inventory and condition report (if any) prepared at the commencement of the tenancy.

§6. I therefore request that the full Deposit of £________ now be repaid to me. Please arrange for payment to be made within five (5) working days of the date of this letter by the following method:

§8. Please note that, under section 213 of the Housing Act 2004, any sum properly deducted may only be retained in accordance with the rules of the applicable tenancy deposit protection scheme and the terms of the Tenancy Agreement. You are not entitled to make any deduction for fair wear and tear.

§9. If I do not receive either repayment of the Deposit in full, or your written response containing the particulars and evidence referred to in §7 above, within five (5) working days of the date of this letter, I shall treat the Deposit as being unfairly withheld. In that event I reserve my right, without further notice to you, to:

1. raise a dispute and request an adjudication under the free dispute resolution service operated by the relevant tenancy deposit protection scheme; and/or
2.
