RE: REQUEST FOR REPAIRS AND MAINTENANCE OF THE TENANTED PREMISES

§ 1. The Tenancy. I, ________, am the tenant/licensee in lawful occupation of the premises more particularly described below (the “Premises”) under and by virtue of the Lease/Leave and Licence Agreement dated ________ executed between us (the “Agreement”):

§ 2. Subject Matter. I am writing in respect of certain repairs and maintenance which have become necessary at the Premises and which fall to be carried out by you as the landlord/lessor pursuant to the terms of the Agreement and the obligations cast upon a lessor under Section 108 of the Transfer of Property Act, 1882, read with the applicable rent control / tenancy legislation in force in the State of ________.

§ 3. Particulars of Defect / Repair Required. The following defect(s) require attention, and I hereby call upon you to carry out the under-mentioned repair(s):

§ 4. Date of Defect / First Observed. The said defect was first observed / arose on or about ________, and the same materially affects the safe, peaceful and habitable enjoyment of the Premises.

§ 5. Obligation to Repair. Under Clause ________ of the Agreement and the aforesaid statutory provisions, the responsibility for the said repair(s) rests with you as the landlord/lessor. You are accordingly requested to attend to and complete the repair(s) at your own cost.

§ 6. Time for Compliance. I request that the said repair(s) be carried out and completed within ________ days from the date of receipt of this letter, or earlier if the nature of the defect so warrants having regard to safety and habitability.

§ 8. Reservation of Rights. This letter is issued without prejudice to, and with full reservation of, all my rights and remedies available under the Agreement and under law. In the event the said repair(s) are not carried out within the time stipulated above, I reserve the right, after due notice and in accordance with law, to undertake the repair(s) myself and to recover/adjust the reasonable cost thereof from the rent payable and/or the security deposit, and/or to seek such further relief as may be available to me, including before the appropriate Rent Authority / Court at ________.
