§ 1. This letter constitutes a formal written warning issued under the disciplinary procedure of ________ (the "Company") in respect of your employment in the role of ________. It is issued in accordance with the principles of natural justice and fair procedures and having regard to the Code of Practice on Grievance and Disciplinary Procedures (S.I. No. 146 of 2000) made under the Industrial Relations Act 1990, the Unfair Dismissals Acts 1977 to 2015, and the Workplace Relations Act 2015.

§ 2. Background. It will be recalled that on ________ you attended a meeting with ________, at which you were issued with a verbal warning concerning unsatisfactory performance in the workplace. At that meeting it was agreed that specified measures would be taken by you to address the matters of concern.

§ 3. You were advised at that time that, should your performance fail to improve to the required standard within a period of ________ (________) months, further disciplinary action might follow.

§ 6. Review and consequences. A review of your performance will be conducted at the end of a period of ________ (________) months from the date of this letter to assess the progress made. Should the necessary improvements not be achieved and sustained within that period, you may be subject to further disciplinary action up to and including a final written warning and, ultimately, the termination of your employment.

§ 7. Right of appeal. You are entitled to appeal against this warning. Any appeal should be submitted in writing to ________, ________, within ________ working days of the date of this letter, setting out the grounds of your appeal. An appeal will be heard by a person not previously involved in this matter.

§ 8. Representation and records. You are reminded of your right to be accompanied and represented by a work colleague or trade union representative at any disciplinary or appeal meeting. A copy of this warning will be retained on your personnel file. This warning will remain active on your file for a period of ________ (________) months, after which, subject to satisfactory conduct and performance, it will be disregarded for disciplinary purposes.
