MODEL RELEASE AGREEMENT

This Model Release Agreement (this “Release”) is made and entered into as of ________ (the “Effective Date”), by and between the following parties:

§ 1. Grant of Rights. I, ________, in consideration of the sum of ________ and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, do hereby irrevocably grant and assign to ________, together with their respective legal representatives, agents, licensees, successors, assignees, and transferees (collectively, the “Releasees”), the perpetual, worldwide, royalty-free, and assignable right and permission to use, reuse, publish, republish, reproduce, modify, adapt, distribute, display, transmit, and otherwise exploit, in whole or in part, for any lawful artistic, editorial, or commercial purpose — including, without limitation, advertising, promotion, trade, publication, and illustration — the photographs, images, video, and other media depicting me and/or my property, of the following description:

captured on or about ________ (collectively, the “Images”).
§ 2. Scope of Use. The grant set forth in § 1 extends to the use of the Images, whether individually or in combination with any other images, text, or material, in any and all forms and media now known or hereafter devised, including, without limitation, print media, digital media, the Internet, social media, composite or altered images, and distorted representations, in such manner as the Photographer may determine in their sole and exclusive discretion. The Photographer is further authorized to use my name in connection with the Images or, alternatively, to attribute the Images to a fictitious name.
§ 3. Release of Claims. I hereby fully and forever release, discharge, and hold harmless the Releasees from any and all claims, demands, causes of action, liabilities, damages, and expenses of every kind and nature, whether known or unknown, arising out of or in any way connected with the creation or use of the Images, including, without limitation, any claim for violation of the right of publicity, right of privacy, defamation, libel, false light, or any claim based upon blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise.
§ 4. Waiver of Inspection. I expressly waive any right to inspect or approve the finished Images, copy, or printed or electronic matter that may be used in connection therewith, or any use to which the Images may be applied.
§ 5. Ownership. I acknowledge and agree that the Photographer is and shall remain the sole and exclusive owner of all right, title, and interest, including all copyright, in and to the Images, and that I have no right, title, or interest therein.
§ 6. Binding Effect. This Release shall inure to the benefit of the legal representatives, licensees, heirs, successors, and assignees of the Photographer, and shall be binding upon me and my heirs, executors, administrators, successors, assignees, and legal representatives.
§ 7. Nudity. ________ (indicate whether the work includes nudity). If applicable, I specifically acknowledge and agree that the nature of the work may include full or partial nudity, and I hereby knowingly and voluntarily consent and agree to appear fully or partially nude in the work.
§ 8. Excluded Uses. Notwithstanding the foregoing, the following uses are specifically excluded from this Release:

§ 11. Governing Law; Venue. This Release shall be governed by and construed in accordance with the laws of the State of ________, without regard to its conflict of laws principles. The parties consent to the exclusive jurisdiction and venue of the state and federal courts located in ________ County, State of ________ for the resolution of any dispute arising out of or relating to this Release.
§ 12. Severability. If any provision of this Release is held to be invalid, illegal, or unenforceable, such provision shall be deemed modified to the minimum extent necessary to render it enforceable, and the remaining provisions shall continue in full force and effect.
§ 13. Voluntary Execution. I affirm that I am signing this Release voluntarily and of my own free will, that I have had the opportunity to seek independent legal advice, and that no oral representations, statements, or inducements apart from this written agreement have been made to me.
