RE: NOTICE TO TERMINATE TENANCY AND REQUEST FOR RETURN OF TENANCY DEPOSIT

Property: ________ (the “Property”)

Tenancy Agreement dated: ________ (the “Tenancy Agreement”)

1. Purpose of this notice

1.1 I write to give you formal notice of my intention to bring to an end the assured shorthold tenancy of the Property granted under the Tenancy Agreement, in accordance with the terms of that agreement and with the Housing Act 1988 and the Protection from Eviction Act 1977.

1.2 This letter also constitutes a formal request for the return of my tenancy deposit pursuant to the tenancy deposit protection requirements set out in sections 212 to 215 of the Housing Act 2004.

2. Notice of termination

2.1 The Tenancy Agreement requires the tenant to give the landlord written notice of: ________.

2.2 In accordance with that requirement, I hereby give notice that the tenancy will terminate and that I (together with any other occupiers) will give up vacant possession of the Property on ________ (the “Termination Date”).

3. Condition of the Property and tenant’s obligations

3.1 I confirm that I have complied with all of my obligations under the Tenancy Agreement.

3.2 The Property will be left in the condition required by the Tenancy Agreement, fair wear and tear excepted, and cleared of all my possessions.

3.3 To the best of my knowledge there is no damage to the Property beyond fair wear and tear, and there are no outstanding payments of rent or other sums due under the Tenancy Agreement as at the Termination Date.

4. Return of the deposit

4.1 A deposit of £________ (________) was paid on or about ________ and was (or ought to have been) protected in the following Government-authorised tenancy deposit scheme: ________, under reference ________.

4.2 I request that the full deposit, together with any interest properly due, be returned to me within ten days of agreement being reached as to the sum to be repaid, in accordance with the rules of the relevant tenancy deposit scheme. Please make payment by the following method:

4.3 If you intend to withhold or deduct any sum from the deposit, please write to inform me, setting out the reasons and a full breakdown of any proposed deductions, within ten working days of the Property being vacated.

5. Return of keys and final inspection

5.1 Please confirm receipt of this notice in writing and provide details of any arrangements required for the return of keys and a final inspection of the Property.

5.2 I would be grateful if you would confirm the date and time on which the Property will be inspected so that I may be present if I wish to do so, and so that a record of the condition of the Property (including a check-out inventory) may be agreed.

7. General

7.1 Nothing in this notice shall be taken as a waiver of any of my rights under the Tenancy Agreement or at law.
