Re: Formal Appeal Against Parking Charge Notice
§ 1. I write further to the Parking Charge Notice referenced above, which was issued to me by you (a) on the windscreen of the above vehicle, or (b) by post pursuant to Schedule 4 of the Protection of Freedoms Act 2012, on ________. By this letter I formally appeal against and dispute liability for the Parking Charge Notice.
§ 2. I dispute that any contractual or other liability arises in respect of the Parking Charge Notice for the following reasons:
(a) The vehicle was not parked or used in breach of any term applicable to the car park at the relevant time. It was parked fully in accordance with the terms and conditions, signage and bay markings displayed at the car park, for the following reasons:

(b) Further and in the alternative, I rely upon the following additional grounds in support of this appeal:

(c) Accordingly, no sum is properly due or payable to you, and the Parking Charge Notice is not justified, valid or enforceable.
§ 3. Without prejudice to the foregoing, I put you to strict proof of your entitlement to issue and enforce the Parking Charge Notice. I require you to provide, within 14 days of the date of this letter:
(a) evidence of the identity of the landowner or occupier of the relevant land and a copy of the contract or written authorisation conferring upon you the right to manage parking and to issue and enforce parking charges at this location;
(b) a clear, dated copy of all signage and terms and conditions relied upon as forming the basis of the alleged contract, together with details of their location at the car park;
(c) all photographic and other evidence relied upon in support of the alleged contravention; and
(d) a breakdown demonstrating that the charge represents a genuine pre-estimate of loss or is otherwise a proportionate sum recoverable in law, having regard to the principles in ParkingEye Ltd v Beavis [2015] UKSC 67 and the Consumer Rights Act 2015.
§ 5. To the extent that you have processed my personal data, including data obtained from the Driver and Vehicle Licensing Agency, I require confirmation that such processing complies with the UK General Data Protection Regulation and the Data Protection Act 2018.
§ 6. I therefore request that you cancel the Parking Charge Notice referred to above forthwith and confirm in writing that no further action will be taken against me in respect of this matter.
§ 8. I look forward to receiving your substantive response within 14 days of the date of this letter. In the absence of a satisfactory reply, I reserve the right to refer this matter to the relevant independent appeals body and, in the event of any proceedings being issued, to rely upon this correspondence, including on the question of costs and conduct pursuant to the Civil Procedure Rules.
§ 9. Please address all further correspondence to me at the address set out above and confirm receipt of this letter.
