Dear ________,
RE: Request for the Return of My Tenancy Deposit – ________
1. I am writing in response to your letter dated ________, in which you informed me that you intend to withhold all or part of my tenancy deposit. This letter concerns the assured shorthold tenancy of the property located at:
________
2. The relevant particulars of the tenancy are as follows:
2.1 Date of commencement of the tenancy: ________;
2.2 Total deposit paid: £________;
2.3 Tenancy deposit protection scheme in which the deposit is (or should have been) protected: ________;
2.4 Deposit protection reference number: ________;
2.5 Date on which I vacated the property and returned the keys: ________.
3. I confirm that I gave up possession of the property in accordance with the terms of the tenancy agreement and that, to the best of my knowledge, I have complied with all of my obligations under that agreement.
4. I have carefully considered the reasons for the proposed deductions set out in your letter of ________. I do not agree with your decision and wish to challenge it on the following grounds:
4.1 ________;
4.2 ________.
5. As regards any alleged rent arrears, I have made all rent payments promptly as required by the tenancy agreement (see clause ________). I have enclosed proof of all rent payments. Should you contend that any rent remains unpaid, please provide full particulars, including the periods and amounts said to be outstanding.
6. As regards any alleged damage to the property, I would remind you that you are not entitled to make deductions for fair wear and tear arising from the reasonable use of the property over the period of the tenancy. I refer you to the check-in and check-out inventory reports, and I invite you to identify, by reference to those reports, any damage that you say goes beyond fair wear and tear.
7. Under the Housing Act 2004 and the associated tenancy deposit protection requirements, the burden of demonstrating that deductions are justified rests with you as landlord. I therefore request that, within 14 days of the date of this letter, you provide me with copies of all invoices, receipts, estimates, photographs and other documentary evidence relied upon in support of each proposed deduction.
9. Where the deposit is protected in an authorised scheme, I am entitled to use that scheme's free Alternative Dispute Resolution service. If we are unable to reach agreement, I require that this dispute be referred to the relevant tenancy deposit protection scheme for adjudication, and I will provide the scheme with all relevant evidence in support of my position.
10. Accordingly, I request that you reconsider your decision and refund the sum of £________ to me within 14 days of the date of this letter. Please make payment by ________ to the following account:
Account name: ________;
Sort code: ________;
Account number: ________.
12. This letter is sent without prejudice to any of my rights and remedies, all of which are expressly reserved.
I look forward to receiving your response and to resolving this matter cooperatively.
Yours sincerely,
________
