RE: TERMINATION OF EMPLOYMENT ON GROUNDS OF CONDUCT
1. Following the disciplinary hearing held on ________, which you attended (or were given the opportunity to attend), I am writing to confirm the decision to dismiss you from your position of ________ with ________ ("the Company"). This decision has been taken in accordance with the Company's disciplinary procedure and the ACAS Code of Practice on Disciplinary and Grievance Procedures.
2. In accordance with your contract of employment and section 86 of the Employment Rights Act 1996, you are entitled to ________ notice of the termination of your employment. Accordingly, your employment with the Company will terminate on ________ ("the Termination Date").
3. Your employment is being terminated on grounds of conduct. The specific reasons for this decision are as follows:

4. You have previously received ________ formal warning(s) in relation to your conduct, the most recent of which was issued to you on ________. Those warnings set out the improvements required of you and the consequences of any failure to achieve them. Regrettably, the Company has concluded that the required improvement has not been made, and for this reason the decision to dismiss has been taken.
5. You will be paid your salary and any accrued contractual benefits up to and including the Termination Date. The final day in respect of which you will be paid is ________, and this payment will be made to you on ________, subject to the usual deductions for income tax and National Insurance contributions.
6. You will also receive payment in lieu of any accrued but untaken holiday entitlement as at the Termination Date, calculated in accordance with the Working Time Regulations 1998 and your contract of employment. The amount of any such payment is ________.

On or before the Termination Date, you must return to the Company all documents, materials, equipment, keys, security passes and any other property belonging to the Company (or any associated company) that is in your possession or under your control, together with all copies thereof in whatever medium held.

12. Nothing in this letter affects any statutory rights you may have, including any right to bring a claim before an Employment Tribunal, which is generally subject to a time limit of three months less one day from the Termination Date (subject to the ACAS early conciliation procedure).
