OUR AGREEMENT
1. THE PARTIES
1.1. Host Family
The first party to this agreement is the Host Party. The Host Party is:

2. OUR AGREEMENT
2.1. This Agreement confirms the arrangements for the Au Pair to come and live with the Host Family, as a member of the family.
2.2 During the Term of the Agreement the Au Pair will be given the opportunity to gain experience caring for children and to develop cultural, linguistic and social skills.
2.3. The Au Pair will help the Host Family with light housework and childcare, as defined below.
2.4. The Agreement between the Au Pair and the Host Family shall not constitute or imply any relationship of employer and employee, partnership, joint venture, fiduciary relationship, tenant and landlord.
3. TERM OF AGREEMENT
3.1. The Agreement will commence on ________ when the Au Pair will move in with the Host Family (the Commencement Date).
3.2. The Parties have agreed that the Au Pair will stay with the Host Family for a period of ________ months from the Commencement Date.
3.3. The Agreement will terminate ________ month and 1 day after the Commencement Date (the Term) unless the Agreement is extended.
3.4. The Term may be extended by mutual written agreement between the Host Family and the Au Pair.
4. AU PAIR OBLIGATIONS AND ENTITLEMENTS
4.1. During the Term of the Agreement, the Au Pair will have Duties, which will comprise of helping with general household tasks, light housework and childcare including:

4.2. The Au Pair must conduct themselves in a respectful and appropriate manner whilst conducting their Duties and whilst they are living in the family home.
4.3. The Au Pair must not take part in any illegal or disreputable acts or conduct during the course of the Agreement, including (but not limited to):
(a). fraud, theft or any dishonest act;
(b). any attempted or fulfilled act of violence, abusive or threatening behaviour towards people or property;
(c). being inebriated, drunken, disorderly or in a state of non-sobriety when caring for and looking after the child of the Host Family; or
(d). any irresponsible act or behaviour carried out by the Au Pair which in the opinion of the Host Family would reasonably put the child or Host Family in danger or could result in their injury.
4.4. The Au Pair will be treated as a member of the Host Family and will not be expected to have sole responsibility for the whole of the running of the household.
4.5. The Au Pair shall be required to undertake the Duties for a maximum of ________ hours per week. These hours shall be flexible and subject to change as is necessary for the family life and activities of the Parties.
4.6. During the Term of the Agreement, the Host Family shall provide the Au Pair with Weekly Pocket Money of £________ (________).
4.7. The Weekly Pocket Money shall be for the Au Pair to spend how they please and they shall not be expected to spend this in the fulfilment of their obligations under this Agreement.
4.9. The Au Pair shall be entitled to ________ full days off each week where they will not undertake any Duties as an au pair. These days shall be discussed and arranged between the parties to fit around their respective schedules, including any study obligations of the Au Pair.
4.10. The Au Pair will be given ________ full days holiday during the Term. During these days the Au Pair will not be required to carry out any Duties for the Host Family. The holiday days can be scheduled in consultation and agreement with the Host Family with reasonable notice.
5. LIVING ARRANGEMENTS
5.1. During the Term the Au Pair shall be resident at the home of the Host Family at their address and the Au Pair will not be charged any rent or board for this.
5.2. The Au Pair shall be provided with their own private bedroom and bathroom in the family home. The bedroom shall be furnished with the following furniture:

5.3. The Au Pair should keep their bedroom and bathroom in a habitable, appropriate and clean state.
6. HOST FAMILY OBLIGATIONS
6.1. The Host Family shall treat the Au Pair as a member of the family and shall make every effort to help the Au Pair settle in and feel welcome and comfortable in the family home.
6.2. The Host Family shall provide the Au Pair with their main meals each day, which the Au Pair will usually take together with the family.
6.3. The Host Family shall provide the Au Pair with reasonable free time to enable them to pursue their studies, attend language classes and undertake their own cultural, social and leisure activities.
6.4. The Host Family shall ensure that the Duties required of the Au Pair are reasonable, suitable and consistent with the terms of this Agreement, and shall not require the Au Pair to undertake any tasks which are unsafe or inappropriate.
7. VISAS AND HEALTHCARE
7.1. The Au Pair has been requested as a condition of this agreement to secure and provide proof of an appropriate visa.
7.2. The Au Pair must have made appropriate arrangements in place to ensure that they can access health care during their stay with the Host Family, including making the appropriate payment for the Health Surcharge as part of their visa application.
7.3. The Host Family will reimburse the costs of a successful visa application to the Au Pair. The Host Family will provide the reimbursement upon receipt of proof of the visa and the receipt showing the relevant costs incurred.
7.4. If this Agreement terminates by reason of the Au Pair's breach of any term or obligation, they must repay the cost of the visa to the Host Family within 4 weeks of the termination dated.
7.5. If, for any reason, the Au Pair's visa is terminated or revoked then this Agreement shall terminate immediately.
8. TERMINATION
8.1. Either party shall be able to terminate this Agreement at any time during the Term of the Agreement by providing no less than 2 weeks of written notice.
8.2. Once this Agreement has terminated, the Host shall not be required to pay any further Weekly Pocket Money to the Au Pair.
9. SEVERANCE
If any provision or part of any provision of this Agreement is deemed invalid or unenforceable, it shall be treated as though it is erased from the Agreement but the erasure of the provision or part-provision shall not affect the validity or enforceability of the rest of the Agreement.
10. VARIATION
A variation to this Agreement may only be effective if it is made in writing and signed by each party.
11. WRITTEN NOTICE
Each party may give written notice to the other by letter, email, text or WhatsApp message.
12. GOVERNING LAW
This Agreement and any disputes or claims arising out of or in connection with it shall be governed by and construed in accordance with the law of England and Wales.
13. JURISDICTION
Each of the parties irrevocably agrees that the Courts of England and Wales shall have the exclusive jurisdiction to settle any disputes or claims arising out of or in connection with this Agreement.
