RESIDENTIAL SUBTENANCY AGREEMENT
(Alberta)



This subtenancy agreement is made effective as of the date indicated below and is between ________ (the "Tenant") and ________ (the "Subtenant").

The Tenant is party to a lease agreement between the Tenant and ________ dated ________ (the "Master Lease"), a copy of which is attached to this agreement as an exhibit. The Tenant wishes to sublet the leased property to the Subtenant and the Subtenant wishes to sublet the leased property from the Tenant.

The Tenant and the Subtenant therefore agree as follows:


PREMISES

1. The Subtenant agrees to use the Premises for residential purposes only.

2. The Tenant sublets to the Subtenant a property located at the following address:

TERM AND POSSESSION

3. The the Subtenant will take possession effective ________ at ________.

4. The Subtenant will vacate the Premises no later than ________ unless otherwise agreed by the Subtenant and the Tenant in writing.


SUBTENANCY PAYMENTS

5. The Subtenant will pay to the Tenant the sum of of $________ (________) each month.

6. The Subtenant will pay the sum on the 1st (first) of each month.

7. The Subtenant may be required to pay prorated rent from the day on which the Subtenant takes possession to the first full payment period. If the Subtenant must pay prorated rent, the Subtenant will pay any prorated amount due to the execution of this agreement.

This address may be changed from time to time. The Subtenant will be informed in writing prior to the due date of that period's sublease payment if the payment location has changed.

Such address may be changed at will by any party. A party changing their address will provide written notice to the other interested parties as described above.


GOVERNING LAW

10. The laws of the province of Alberta, without giving effect to its principles of of conflicts of laws, and the laws of Canada in effect in the province of Alberta govern all adversarial proceedings arising out of this agreement.


LANDLORD'S CONSENT

11. The Residential Tenancies Act requires the prior written consent of the Landlord to any subletting of the Premises. Such consent has been obtained and a copy is attached as an exhibit.


SEVERABILITY


AMENDMENT OF AGREEMENT

14. This subtenancy agreement may only be amended or modified by a written document duly executed by both the Tenant and the Subtenant.


INCORPORATION OF LEASE

15. This agreement is subject to all of the terms of the Master Lease with the same force and effect as if each provision of the Master Lease were included in this agreement, except as otherwise provided in this agreement.

16. The Subtenant will abide by all the terms and conditions in the Master Lease. The Subtenant is is in possession of a copy of said lease.
