(Pursuant to Rule 74.08 of the Rules of Civil Procedure, R.R.O. 1990, Reg. 194, and the Succession Law Reform Act, R.S.O. 1990, c. S.26)

PROVINCE OF ONTARIO

IN THE MATTER OF the execution of the Will or Codicil of ________, of ________, in the Province of Ontario (the “Testator”).

AFFIDAVIT OF EXECUTION

I, ________, of the ________ of ________, in the Province of Ontario, MAKE OATH AND SAY (or SOLEMNLY AFFIRM):

§ 1. On or about ________, I was present and saw the document now shown to me and annexed and marked as Exhibit “A” to this my Affidavit (the “Document”) duly executed by ________, the Testator named therein.

§ 3. The Testator executed the Document by signing (or by having another person sign on the Testator’s behalf, in the Testator’s presence and at the Testator’s direction) at the end thereof in the presence of myself and of ________, of the ________ of ________, in the Province of Ontario, both of us being present at the same time, and we, the said two witnesses, thereupon attested and subscribed the Document as witnesses in the presence of the Testator and of each other.
