RE: CEASE AND DESIST — INFRINGEMENT OF COPYRIGHT

Demand to cease unauthorised use of copyright works pursuant to the Copyright Act 1968 (Cth)


I write in respect of the copyright works described below and the unauthorised use of those works which has come to my attention.

1. Ownership of the Work

  1. I am the owner (or duly authorised exclusive licensee) of all copyright and other intellectual property rights subsisting in the following original work (the “Work”): ________.
  2. The Work is an original literary, artistic, musical, dramatic or other protected work within the meaning of the Copyright Act 1968 (Cth) (the “Act”) and was first published or made on ________.
  3. Copyright subsists in the Work automatically under the Act without any requirement for registration. I retain and have at all material times retained all rights in the Work, and I have not assigned, licensed or otherwise granted to you any right to use, reproduce, communicate, publish, adapt or otherwise deal with the Work.

2. The Infringing Conduct

  1. It has come to my attention that you have made, and continue to make, unauthorised use of the Work in the following manner:

  2. I refer you to the documents enclosed with this notice, which evidence the infringing conduct described above.

3. Infringement of Copyright

  1. I expressly reserve all rights in respect of any infringement of my moral rights under Part IX of the Act, including the right of attribution, the right against false attribution and the right of integrity of authorship.

4. Demands

  1. I require that you immediately and permanently cease and desist all unauthorised use of the Work. Within ________ days of the date of this notice, you are required to:
    1. cease all reproduction, communication, distribution, display, publication, adaptation and any other use of the Work in any form and by any means;
    2. remove and destroy, or deliver up to me, all copies of the Work (in any medium) in your possession, custody or control, including any copies published online or stored electronically;
    3. provide an account in writing of all dealings with the Work, including the extent of any reproduction, distribution and any revenue or profits derived; and
    4. provide me with written confirmation, signed by you or your authorised officer, that you have fully complied with the demands set out in this notice.

5. Reservation of Rights

  1. This notice is given without prejudice to any rights or remedies available to me, all of which are expressly reserved. Nothing in this notice constitutes a waiver of any such right or remedy.
  2. I urge you to obtain independent legal advice in relation to this matter.
