RE: Notice of Termination of Employment by Reason of Redundancy


Further to our recent individual consultation meeting held on ________, I write with regret to confirm that you have been provisionally and now finally selected for redundancy. This letter constitutes formal notice of the termination of your employment by reason of redundancy in accordance with the Employment Rights Act 1996.


1. Reason for redundancy

1.1 As you are aware, employees were initially notified on ________ that the business was at risk of redundancies because the business is due to close at ________.

1.2 A redundancy is defined for the purposes of section 139 of the Employment Rights Act 1996 as a dismissal attributable wholly or mainly to the fact that the employer has ceased, or intends to cease, to carry on the business for the purposes of which you were employed, or in the place where you were so employed.


2. Outline of the process to date

2.1 Throughout the redundancy selection process and the individual consultation meetings held with you, careful consideration has been given to all possible means by which your redundancy might be avoided, including consideration of any suitable alternative employment. The representations and views you raised during consultation have been given full and genuine consideration.

2.2 Regrettably, as a result of the closure of the business, there are no suitable alternatives to your redundancy. Accordingly, a final decision confirming your selection for redundancy has now been made.


3. Notice of termination of your employment

3.1 In consequence of the above, this letter gives you formal notice that your employment will be terminated by reason of redundancy.

3.2 In accordance with your contract of employment and your statutory entitlement under section 86 of the Employment Rights Act 1996, you are entitled to ________ notice. Your final date of employment (your “Termination Date”) will therefore be ________.

3.3 During your notice period you will be required to ________. All contractual benefits to which you are entitled will cease on the Termination Date.


4. Final salary

4.1 You will receive your final salary, together with your P45, on your usual payday following the Termination Date, subject to the usual deductions for income tax and National Insurance contributions.


5. Holiday pay

5.1 As at the date of this letter, you have ________ days of accrued but untaken annual leave. In accordance with regulation 14 of the Working Time Regulations 1998, your final payment will include a payment in lieu of your untaken statutory and contractual leave entitlement.


6. Statutory redundancy pay

6.2 Your period of continuous employment is calculated by reference to your first day of employment and your Termination Date, in accordance with sections 210 to 219 of the Employment Rights Act 1996.

6.3 As your continuous period of employment is less than two years, you do not, under section 155 of the Employment Rights Act 1996, qualify for a statutory redundancy payment.
