RE: FORMAL NOTICE REQUIRING REPAIRS AT RESIDENTIAL PROPERTY LET UNDER ASSURED SHORTHOLD TENANCY

§1. Introduction

1.1 I write in my capacity as tenant of the residential property situated at the address set out below (the "Property"), which is let to me by you under the tenancy agreement referred to above (the "Tenancy Agreement"):

1.2 This letter constitutes formal written notice to you, as my landlord, of disrepair affecting the Property and of my requirement that you carry out the necessary repairs in accordance with your statutory and contractual obligations.

§2. Previous notification

2.1 I have previously notified you of the need to carry out these repairs on ________.

2.2 That notification had the following outcome:

3.1 The defects and items of disrepair at the Property which require attention are as follows:

3.2 The continuing state of disrepair has materially interfered with my use and enjoyment of the Property and, in particular, has caused or risks causing the following loss, damage or inconvenience:

§4. Your statutory and contractual obligations

4.3 The disrepair and/or hazards described above also engage your duty of care under section 4 of the Defective Premises Act 1972 and may constitute Category 1 or Category 2 hazards under the Housing Health and Safety Rating System pursuant to the Housing Act 2004.

4.4 In addition to the above statutory duties, the Tenancy Agreement places express responsibility on you to carry out repairs to the Property. The Tenancy Agreement provides, at ________, as follows:

§5. Action required and access

5.1 I formally require that you, or a suitably qualified contractor instructed on your behalf, attend the Property to inspect and complete the repairs identified above within a reasonable period, and in any event no later than ________.

5.2 I confirm that I will provide reasonable access to the Property to enable the inspection and works to be carried out, upon receipt of at least 24 hours' written notice as required by section 11(6) of the Landlord and Tenant Act 1985.

5.3 Please confirm in writing, within ________ days of the date of this letter, the date and time upon which you, or your contractor, intend to attend the Property.

§6. Reservation of rights

6.1 Should you fail to attend to these repairs within the period specified above, I reserve the right to pursue all remedies available to me under the Tenancy Agreement and at law, which may include (without limitation): making a complaint to the environmental health department of the local authority, namely ________; commencing proceedings for an order of specific performance and/or damages; instructing contractors to carry out the works and seeking to recover the reasonable cost from you or to set the same off against rent in accordance with established legal principles; and seeking compensation for any loss, damage or inconvenience suffered.

6.2 This letter is sent in accordance with, and is intended to comply with the spirit of, the Pre-Action Protocol for Housing Conditions Claims (England). I would urge you to attend to these matters without delay in order to avoid the need for any formal proceedings.

6.3 Nothing in this letter shall be taken as a waiver of any of my rights, all of which are expressly reserved.
