Dear Sir or Madam,

RE: REQUEST FOR DELIVERY OF UNDELIVERED GOODS – ORDER REFERENCE ________

1. I am writing in respect of a contract for the sale of goods entered into between us. On ________ I purchased the following goods from you (the “Goods”):

________

2. The total price paid by me in respect of the Goods was ________, which was paid in full on ________ by way of ________. The order reference for this contract is set out above.

3. The Goods were to be delivered to me at ________, on or before ________. Notwithstanding that the agreed delivery date has now passed, I have not received the Goods, or any part of them.

5. Where, as here, no binding time for delivery was agreed (or any agreed time has passed), section 28 of the Consumer Rights Act 2015 requires that the Goods be delivered without undue delay and in any event not more than 30 days after the day on which the contract was entered into. That period has now expired.

6. Accordingly, I require that you now arrange for the Goods to be delivered to me, in full and in satisfactory condition, without further delay and in any event within 14 days of the date of this letter. Please confirm in writing by return that you will do so.

7. If you are unable or unwilling to deliver the Goods, or if delivery is not made within the period specified above (which I confirm is now an appropriate and reasonable further period for delivery for the purposes of section 28(7) of the Consumer Rights Act 2015), I shall be entitled to, and hereby give notice that I will, treat the contract as at an end and require a full refund of all sums paid by me in respect of my order, in the sum of ________, pursuant to section 28(8) and (9) of that Act.
