RE: Notification of Pregnancy and Request for Statutory Maternity Leave and Pay
I am writing to give you formal notice, in accordance with the Employment Rights Act 1996, the Maternity and Parental Leave etc. Regulations 1999 (as amended) and the Statutory Maternity Pay (General) Regulations 1986, of my intention to take maternity leave in connection with the birth of my child.
The purpose of this letter is to notify you of the following matters required by law:
- that I am pregnant;
- the expected week of childbirth; and
- the date on which I intend my ordinary maternity leave (and, where applicable, my entitlement to statutory and/or contractual maternity pay) to commence.
1. Personal details
My full name is ________ and my National Insurance number is ________. My job title is ________ and my employment with you commenced on ________.
2. Expected week of childbirth
My baby is due in the week beginning ________. I enclose my original MAT B1 maternity certificate, signed by my doctor or registered midwife, which confirms my expected week of childbirth.
3. Entitlement to maternity leave
I understand that, irrespective of my length of service, I am entitled to 52 weeks' Statutory Maternity Leave, comprising 26 weeks' Ordinary Maternity Leave followed immediately by 26 weeks' Additional Maternity Leave, in accordance with the Maternity and Parental Leave etc. Regulations 1999.
I confirm that I do not intend to begin my maternity leave any earlier than the eleventh week before my expected week of childbirth, save as may otherwise be triggered by law.
4. Date of commencement
I intend my period of maternity leave and (where applicable) maternity pay to commence on ________. I understand that, should I be absent from work for a pregnancy-related reason after the beginning of the fourth week before my expected week of childbirth, or should I give birth before my chosen start date, my maternity leave will be triggered automatically in accordance with the applicable Regulations.
Should I wish to change the date on which my maternity leave is to begin, I will give you notice of the revised date at least 28 days before whichever is the earlier of my original chosen start date or the new start date, or as soon as is reasonably practicable.
5. Statutory and contractual maternity pay
I would also be grateful if you would confirm details of any enhanced contractual maternity pay to which I may be entitled under the terms of my contract of employment or any applicable policy.
6. Return to work
I understand that I am entitled to return to my role at the end of my maternity leave, and that if I intend to return before the end of my full 52-week entitlement I must give you at least eight weeks' notice of the date of my return.
7. Keeping in touch
I understand that I may, by agreement, work for up to ten "keeping in touch" days during my maternity leave without bringing my leave to an end or losing my entitlement to maternity pay, and I should be glad to discuss arrangements for staying in touch during my absence.
