NOTICE SEEKING POSSESSION OF A PROPERTY LET ON AN ASSURED TENANCY OR AN ASSURED AGRICULTURAL OCCUPANCY
(Section 8 of the Housing Act 1988, as amended)

§ 1. Parties and the Tenancy

1.1 This Notice is given by ________ (the Landlord) to the Tenant named above pursuant to section 8 of the Housing Act 1988.

1.2 The Tenant holds the Premises under a tenancy agreement dated ________ (the Tenancy Agreement), which the Landlord considers to be an assured (or assured shorthold) tenancy within the meaning of the Housing Act 1988.

§ 2. Intention to Seek Possession

2.1 The Landlord intends to apply to the court for an order requiring the Tenant to give up possession of the Premises.

2.2 If the Landlord obtains a possession order, the Tenant may be required to pay the Landlord's costs of making the application.

§ 5. Notice Period and Earliest Date for Court Proceedings

5.1 The Landlord will not begin court proceedings to seek possession of the Premises before ________ (the Earliest Date). The Earliest Date is calculated in accordance with the minimum notice period prescribed for the Ground(s) relied upon under section 8(3) to (4B) of the Housing Act 1988.

5.2 Where a Ground requiring not less than two weeks' notice is relied upon, court proceedings will not begin earlier than two weeks after this Notice is served. Where a Ground requiring not less than two months' notice is relied upon, court proceedings will not begin earlier than two months after this Notice is served.

5.3 Court proceedings will not in any event begin earlier than the date on which the tenancy (had it not been an assured tenancy) could have been brought to an end by a notice to quit given on the same date as this Notice.

5.4 If court proceedings are not begun within twelve months of the date of service of this Notice, this Notice will cease to be effective and a fresh notice will be required.

§ 6. Opportunity to Remedy

6.1 Where the Ground(s) relied upon relate to a remediable breach of the Tenancy Agreement, the Tenant may avoid possession proceedings by remedying the breach within ________ days of receipt of this Notice. This period begins on the day after this Notice is deemed to have been received.

6.2 This Notice is deemed to have been received on the day after it is sent or otherwise served. Failure to remedy the breach (where remediable) may result in the Landlord commencing court proceedings for possession on or after the Earliest Date stated in § 5.1.
