EMPLOYMENT AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This EMPLOYMENT AGREEMENT (the "AGREEMENT") is made and executed at the City/Municipality of _____________________, Province of _____________________, this day of _________________, by and between:

WITNESSETH THAT:

NOW THEREFORE, in consideration of the foregoing, the parties hereby agree as follows:

I. DUTIES AND RESPONSIBILITIES

The EMPLOYEE shall perform the following duties and responsibilities:

The EMPLOYER undertakes to ensure that the EMPLOYEE shall not work in any activity that subjects the EMPLOYEE to any form of exploitation or is harmful to the EMPLOYEE 's health and safety or physical, mental or psychosocial development.

II. COMPENSATION

The EMPLOYEE shall be paid a gross rate of ________ (₱________) per day, subject to government-mandated deductions to be borne by the employee, every 1st and 1st day of the month.

The EMPLOYER may, at its discretion, grant bonuses, allowances, or benefits not defined in this contract. Such exercise of discretion shall not be considered as established practice or precedent and shall not be demandable under this Employment Agreement or any other written or unwritten agreement.

III. THIRTEENTH MONTH PAY

The EMPLOYER will pay the mandatory Thirteenth (13th) month pay before 24 December of each calendar year.

IV. MANDATORY BENEFITS

Benefits that are mandated by law or the following document: ________, which has been provided to the EMPLOYEE at the signing of this AGREEMENT, shall be paid or provided by the EMPLOYER only when mandated and applicable to the EMPLOYEE, according to the law or the above-mentioned document.

The work schedule may be changed by the EMPLOYER or its management as it may deem necessary to meet its operational requirements.

The EMPLOYEE may be required to work more than his regular work schedule due to the demands of the business or the requirements of the EMPLOYER.

The EMPLOYEE may be transferred or assigned to other locations as may be required by the needs of the EMPLOYER.

VIII. COMPANY RULES AND REGULATIONS

The EMPLOYEE shall follow all company rules and regulations, written or otherwise. All existing and future company rules and regulations shall be deemed incorporated in this AGREEMENT.

It shall be the duty and responsibility of the EMPLOYEE to be aware of and comply with the EMPLOYER's rules and regulations.

The EMPLOYEE has been provided with a copy of the following document which includes the rules and regulations of the EMPLOYER at the signing of this AGREEMENT: ________.

IX. TERMINATION OF THE EMPLOYEE

The EMPLOYER may terminate the Regular employment (permanent employment) for any of the just or authorized causes provided by law, including analogous causes specified in the company rules and regulations or policy.

X. RETURN OF COMPANY PROPERTYUpon termination or separation from employment for any reason whatsoever, the EMPLOYEE shall immediately return to the EMPLOYER all properties, equipment, documents, records, and other materials belonging to the EMPLOYER that are in the EMPLOYEE's possession or control.

The EMPLOYER may withhold any final pay or clearance until all such company property has been duly returned and accounted for by the EMPLOYEE.

XI. NON-COMPETE AND CONFLICT OF INTEREST
