Dear Sir/Madam,

RE: REQUEST FOR EXTENSION OF TIME TO PAY RENT IN RESPECT OF THE PREMISES SITUATED AT ________

§1. We write with reference to the Tenancy/Lease Agreement dated ________ (the “Agreement”) made between ________ (the “Landlord”) and ________ (the “Tenant”), in respect of the commercial premises situated at ________ (the “Demised Premises”).

§2. The Tenant is presently in lawful occupation of the Demised Premises as a tenant of the Landlord under and by virtue of the said Agreement, and remains willing and committed to fulfilling its obligations thereunder.

§3. We write on behalf of the Tenant respectfully to request an extension of time within which to pay the rent presently due, owing to financial difficulties which have temporarily impaired the Tenant’s ability to meet the said obligation on the due date.

§4. In particular, and without prejudice to the continuing validity of the Agreement, the Tenant’s business has been adversely affected in the following manner:

§5. Pursuant to the Agreement, the Tenant is required to pay an annual rent of ________ (________), which sum fell due for payment on ________ (the “Due Date”).

§6. By reason of the foregoing circumstances, the Tenant respectfully proposes a new date for the payment of the said rent and undertakes to make full payment of the outstanding sum on or before ________ (the “Proposed Payment Date”).

§7. The Tenant kindly requests that the Landlord grant the said extension and forbear from:

(a) levying any interest, late-payment charge, penalty or surcharge in respect of the period of the extension hereby requested;

(b) issuing any statutory notice to quit or notice of the Landlord’s intention to recover possession of the Demised Premises under the applicable tenancy law of ________; and

(c) commencing any proceedings for the recovery of possession or arrears of rent, pending the Proposed Payment Date.

It is intended that any agreement reached pursuant to this request shall be reduced into writing and duly executed by both parties as a variation of the Agreement.
