Dear Sir/Madam,

RE: FORMAL DEMAND FOR REFUND IN RESPECT OF GOODS ORDERED BUT NOT DELIVERED — ORDER REFERENCE NO. ________

I write in respect of the contract for the sale and supply of goods entered into between myself and your company/establishment, the particulars of which are set out below.

§1. Particulars of the Transaction

  1. On ________, I placed an order with you for the supply of the following goods (“the Goods”):

  1. The total contract price for the Goods was the sum of ₦________ (________), which sum I paid to you in full on ________ by way of ________, evidence of which payment is in my possession.
  2. It was an express term of our agreement that the Goods would be delivered to me on or before ________ at the following delivery address: ________.

§2. Breach of Contract

  1. Notwithstanding my full payment for the Goods, you have wholly failed and/or neglected to deliver the Goods on the agreed delivery date or at all. As at the date of this letter, I have received neither the Goods nor any refund of the purchase price.
  2. Your failure to deliver the Goods within the time stipulated constitutes a fundamental breach of our contract and a failure of consideration. The continued retention of my money in these circumstances amounts to an unjust enrichment at my expense.
  3. Your conduct further constitutes a breach of my rights as a consumer under the Federal Competition and Consumer Protection Act 2018, which entitles me, among other remedies, to a full refund of the sums paid for goods that have not been supplied.

§3. Demand

  1. I hereby formally DEMAND that you, within ________ days of the date of receipt of this letter, either:
    1. deliver the Goods in full to me at the delivery address stated above; or
    2. refund to me the complete sum of ₦________ (________) into the bank account particulars set out below:
