Re: Termination of Employment for Just Cause

Dear ________,

§1. Termination for Cause. The purpose of this letter is to confirm that your employment with ________ (the “Company”), in the position of ________, which commenced on ________, is hereby terminated for just cause, effective ________ (the “Termination Date”).

§2. Grounds for Termination. Your conduct is inconsistent with the Company’s workplace policies and with your fundamental obligations as an employee, and constitutes wilful misconduct, disobedience or wilful neglect of duty that has not been condoned by the Company. Such conduct amounts to just cause for summary dismissal at common law and to wilful misconduct within the meaning of the applicable employment standards legislation, namely the ________. The particulars of the breach include:

§3. Prior Warnings. Prior to the date of this letter, you received the following warnings and notices in respect of the foregoing or related conduct:

§4. Effect of Termination. Based upon the foregoing, the Company is compelled to terminate your employment for just cause as of the Termination Date set out above. As your employment is terminated for just cause, the Company takes the position that you are not entitled to notice of termination, pay in lieu of notice, or severance pay at common law or under the ________.

§5. Final Pay. You will be paid all of your regular wages earned and all outstanding vacation pay accrued to the Termination Date, less any required statutory source deductions and withholdings, including, without limitation, all amounts required to be withheld and remitted pursuant to the Income Tax Act, R.S.C. 1985, c. 1 (5th Supp.), the Canada Pension Plan, R.S.C. 1985, c. C-8, and the Employment Insurance Act, S.C. 1996, c. 23. Such payment shall be made within the time prescribed by the applicable employment standards legislation.
