11.1 The personal information collected in this application is collected by the agent and/or owner identified in § 2 for the purpose of assessing the applicant’s suitability for the tenancy, verifying the information provided, and, if the application is successful, preparing and administering the residential tenancy agreement.

11.4 Where information about the applicant is, or may be, listed on a residential tenancy database, the applicant is entitled to be notified in accordance with the applicable residential tenancies legislation in the State or Territory identified in § 1.5.

2. This application does not constitute a binding lease or residential tenancy agreement, and no tenancy is created unless and until a written residential tenancy agreement is executed by all parties. The agent and/or owner is under no obligation to accept this application and is not required to provide reasons for any decision.
3. I understand that the agent and/or owner may rely on the information provided in this application in deciding whether to accept it, and that providing false or misleading information may result in the application being rejected, and may, where applicable, constitute an offence.
4. I consent to the collection, use and disclosure of my personal information for the purposes set out in the Privacy Collection Notice in § 11, in accordance with the Privacy Act 1988 (Cth) and the residential tenancies legislation applicable in the relevant State or Territory.
5. I authorise the agent and/or owner to make such enquiries as they consider necessary to verify the information in this application, including contacting my employer(s), referees, and current and previous lessors or agents, and I authorise those persons to disclose relevant information for that purpose.
6. I acknowledge that any holding deposit or fee paid in connection with this application is paid and refundable only in accordance with the applicable residential tenancies legislation.
