Dear Sir or Madam,

RE: FORMAL COMPLAINT REGARDING FAULTY GOODS – THE CONSUMER RIGHTS ACT 2015

I am writing to make a formal complaint in respect of goods sold to me by you which are not of satisfactory quality. This letter is sent in accordance with my statutory rights under the Consumer Rights Act 2015 (the "Act").


1. Details of My Purchase

1.1 This complaint concerns the following goods, which I purchased from you as a consumer (within the meaning of section 2(3) of the Act) under a distance contract concluded via your website on ________: ________.

2. Nature of My Complaint

2.1 Following delivery, I discovered that the goods are faulty. The goods do not conform to the contract because they are not of satisfactory quality, contrary to the term implied into the contract by section 9 of the Act, and/or are not fit for their intended purpose, contrary to section 10 of the Act, and/or do not match their description, contrary to section 11 of the Act.

2.3 By virtue of section 19(14) of the Act, where goods do not conform to the contract at any time within six months of delivery, they are presumed not to have conformed on the day of delivery, unless you can prove otherwise or the presumption is incompatible with the nature of the goods or the lack of conformity.

5. The Remedy I Require

5.1 I hereby exercise my short-term right to reject the goods pursuant to sections 19(3)(a), 20 and 22 of the Act.

5.2 I notified you of the fault within 30 calendar days beginning with the day after delivery (or the day after the goods were supplied), and I am therefore within the time limit prescribed by section 22(3) of the Act for exercising the short-term right to reject.

5.3 Accordingly, I require a full refund of the price paid for the goods, in the sum of £________ (________).

5.4 In accordance with section 20(8) of the Act, you are responsible for any reasonable costs of returning the goods. Please confirm the arrangements you wish to make for the return of the goods.
