FORMAL GRIEVANCE – DISCRIMINATION AND PROHIBITED CONDUCT UNDER THE EQUALITY ACT 2010

1. Introduction and Summary

1.1 I am writing to raise a formal grievance in accordance with the Acas Code of Practice on Disciplinary and Grievance Procedures and your organisation's grievance procedure. This letter should be treated as the commencement of the formal stage of that procedure.

1.2 I believe that I have been subjected to treatment that constitutes prohibited conduct under the Equality Act 2010 ("the Act").

6. Legal Provisions

6.1 The conduct described above falls, in my view, within the meaning of direct discrimination as defined in section 13 of the Equality Act 2010, which provides that a person (A) discriminates against another (B) if, because of a protected characteristic, A treats B less favourably than A treats or would treat others.

6.2 In so far as it is relevant, I further rely on the prohibitions against indirect discrimination (section 19), harassment (section 26) and victimisation (section 27) of the Act, to the extent that the conduct complained of also falls within those provisions.

6.4 I draw your attention to your obligations under the Act and to the fact that I am protected from suffering any detriment as a consequence of raising this grievance, by reason of the victimisation provisions in section 27 of the Act.

7. Action Requested

7.1 I ask that this grievance be investigated in full and without delay under your grievance procedure, and that I be invited to a grievance meeting at which I may be accompanied in accordance with section 10 of the Employment Relations Act 1999.
