Dear ________,
Notification that you are at risk of redundancy and invitation to a redundancy consultation meeting
§ 1 — Background and process to date
1.1 As you may already be aware, I first informed affected members of staff on ________ that I was considering the possibility of making redundancies within the workforce. A redundancy situation, within the meaning of section 139 of the Employment Rights Act 1996, has arisen for the following reasons:
________
1.2 Before reaching the position set out in this letter, I have carefully considered whether compulsory redundancies might be avoided or reduced. In particular, I have explored alternative measures, including (without limitation) changes and reductions to staff working hours, the restriction of recruitment, and a review of the deployment of existing staff.
§ 2 — Provisional redundancy proposals
2.1 Notwithstanding the measures referred to above, I regret to inform you that I currently anticipate that it will not be possible to avoid making one compulsory redundancy within the business.
2.2 In accordance with the present and anticipated needs of the business, I expect that any such redundancy will be made from the following department or pool: ________.
2.3 As you are employed within the above department or selection pool, I must inform you that you are, regrettably, provisionally at risk of redundancy. I wish to emphasise that no final decision has been taken at this stage, and that this letter is sent for the purpose of beginning a genuine and meaningful consultation with you.
§ 3 — Proposed selection criteria
3.1 Any final selection for redundancy from the department or pool described above will be made by reference to objective selection criteria, which are presently proposed to be as follows:
________
3.2 The selection criteria are provisional and remain open to discussion as part of the consultation process. I welcome any comments or representations you may wish to make in respect of them.
§ 4 — Invitation to an individual consultation meeting
4.1 I invite you to attend an individual consultation meeting with me to take place on ________ at ________. The meeting will be held at ________.
4.2 You are entitled, if you wish, to be accompanied at the meeting by a work colleague or by an official of a trade union. Please confirm the identity of any companion in advance of the meeting.
4.3 I would be grateful if you would confirm whether the above date and time are convenient for you, and the name of any companion who will accompany you, by no later than close of business on ________. If the proposed date or time is not suitable, please let me know and I will seek to make alternative arrangements. Please also inform me if you require any reasonable adjustments to assist your attendance, in accordance with the Equality Act 2010.
§ 5 — Matters to be discussed at the meeting
5.1 At the meeting we will discuss the proposals set out in this letter in detail. You will be given a full and genuine opportunity to ask questions, raise issues and make suggestions. In particular, I intend to cover the following matters:
(a) the reasons for the proposed redundancy situation, and any questions you may have about them;
(b) any views you may have as to how compulsory redundancy might be avoided, including the availability of suitable alternative employment within the business;
(c) further information about the identification of the relevant department or selection pool, why you have been placed at risk of redundancy, and any questions you may have about this;
(d) further information about the proposed selection criteria, and any comments or suggestions you wish to make about them;
(e) any representations you wish to make as to why you should not be selected for redundancy;
(f) the anticipated terms of any redundancy, including notice and any redundancy payment to which you may be entitled under sections 135 and 162 of the Employment Rights Act 1996; and
(g) any other issues or questions which you may wish to raise.
5.2 You may find it helpful to consider in advance of the meeting any specific or additional points you wish to raise. You are welcome to submit any written representations, suggestions or concerns to me before the meeting, and these will be given full and proper consideration.
§ 6 — Next steps and timescale
6.1 Following the meeting, I will give careful consideration to all information, representations and suggestions made by you (or on your behalf) before reaching any final decision regarding the compulsory redundancy. Where appropriate, I may convene one or more further meetings as part of the consultation process before any final decision is made.
6.2 You will be notified in writing once a final decision has been reached, and you will be given the opportunity to attend a further meeting to discuss that decision. You will also be informed of your right to appeal against any decision to dismiss you by reason of redundancy. It is presently my intention to reach a final decision on or before ________.
§ 7 — Assurance
Yours sincerely,
