1. DEFINITIONS AND INTERPRETATION

1.1. These terms and conditions constitute a legally binding contract between us. I refer to these terms and conditions throughout as the "Agreement".

1.2. I (________) am the first party to this Agreement. I will refer to myself as "I", "me" or "my" throughout the Agreement.

1.3. You are the second party to this Agreement. Reference to "you" or "your" means any dog owner who is purchasing the Services.

1.4. Reference to "our", "we" and "us" means the first party and the second party together.

1.5. "Your Dog" means any dog or dogs specified by you in the Information Form, which shall be the subject of this Agreement.

1.6. The "Services" means the dog walking services provided by me in accordance with this Agreement (as further described in Section 2).

1.7. The "Information Form" means the form annexed to this Agreement which you must complete in respect of your Dog.

1.8. This Agreement is a contract for the supply of services to a consumer and your statutory rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 are not affected by anything in this Agreement.


2. THE SERVICES

2.1. The Services which I will perform in accordance with this Agreement comprise walking your Dog and taking your Dog for exercise.

2.2. I will perform the Services for you on the dates and times agreed between us, in accordance with my available working times, which are generally:

2.3. The times and dates upon which I will perform the Services will be agreed between us using the relevant booking method (as defined in Section 3).

2.4. I will typically walk other dogs together with your Dog, but I will never walk more than ________ dogs at any one time.

2.5. At the start of each walk, I will collect your Dog from the address specified in the Information Form.

2.6. At the conclusion of each walk, I will return your Dog to the address specified in the Information Form.

2.7. I will usually perform the Services within the local area surrounding your address.

2.8. All walks will take place within the following areas:

2.9. Any trips outside of the Agreed Area will be explicitly agreed between us in advance.

2.11. In accordance with section 49 of the Consumer Rights Act 2015, I will perform the Services with reasonable care and skill.

2.12. I will perform the Services in a manner consistent with recognised professional dog walking guidance and good industry practice.

2.13. I will ensure that I perform the Services in accordance with all relevant legal requirements, including (but not limited to):

2.13.a. the Animal Welfare Act 2006;

2.13.b. the Animals Act 1971;

2.13.c. the Control of Dogs Order 1992;

2.13.d. the Dangerous Dogs Act 1991 (as amended);

2.13.e. the Microchipping of Dogs (England) Regulations 2015 (or equivalent applicable regulations);

2.13.f. the Highway Code; and

2.13.g. the Countryside Code.

2.14. I hold public liability insurance. I am insured with ________ under policy number ________. If you would like to see a copy of my policy details or insurance certificate, please ask me.


3. COMMENCEMENT AND BOOKINGS

3.1. You must provide me with the following documents before I can provide the Services to you:

3.1.a. a completed copy of the attached Information Form (one per dog if you own more than one dog); and

3.1.b. a signed copy of this Agreement.

3.2. This Agreement will commence and be in force once I have accepted your first booking and we have both signed a copy of this Agreement (the "Start Day").

3.3. I will provide you with notice once your booking has been accepted.

3.4. Where this Agreement is concluded at a distance or off my premises, you have the right to cancel within 14 calendar days from the Start Day under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (the "Cooling-off Period"), as set out in Section 4. I will not commence the Services within any applicable Cooling-off Period unless you provide your explicit request for me to do so.

3.5. We may reach a mutual rolling arrangement for a regular walking schedule for your Dog, or alternatively you may make future individual bookings by giving not less than ________ days' notice by telephone.


4. YOUR RIGHT TO CANCEL

Statutory Cooling-off Period

4.1. Where the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 apply, you may cancel this Agreement within 14 calendar days of the Start Day without giving any reason.

4.2. The Cooling-off Period will expire 14 calendar days from the Start Day.

4.3. I will not provide any of the Services during the Cooling-off Period unless you explicitly request, in writing, that I do so. If you do request that I perform the Services during the Cooling-off Period, you acknowledge that you will lose your right to cancel once the Services have been fully performed, and you must pay for any Services supplied up to the point you cancel.

4.4. To exercise the right to cancel, you must inform me of your decision to cancel this Agreement by a clear statement (for example, a letter sent by post or an email). You may use the attached Cancellation Form, but you are not obliged to do so.

4.5. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the Cooling-off Period has expired.

4.6. If you cancel this Agreement in accordance with this section, I will reimburse to you all payments received from you, subject to a deduction for any Services already supplied at your request prior to cancellation.

4.7. I will make any reimbursement without undue delay and not later than 14 calendar days after the day on which you informed me of your decision to cancel.

4.8. I will make any reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

After the Cooling-off Period (or where no Cooling-off Period applies)

4.9. If you wish to cancel a single confirmed booking after the Cooling-off Period (or from the Start Day if no Cooling-off Period applies), I ask that you do so not less than 24 hours prior to the agreed start time of the walk, by telephone.

4.10. Either party may terminate the whole of this Agreement (that is, all future bookings) at any time by giving not less than 24 hours' notice prior to the next booking.

4.11. If you cancel less than 24 hours prior to your booking, you will still be required to pay for that Service. I may, at my discretion, waive this requirement if I am able to fill the slot with an alternative customer.


5. PAYMENT TERMS

5.1. I will charge you for each walk.

5.4. If you are instructing me on a long-term basis, I will accept regular monthly advance payments to cover all Services booked in a monthly period. We may agree a monthly payment date by mutual agreement.

5.6. If you fail to make any payment due to me by the relevant payment date, I may decline to provide the Services until payment has been received in full.

5.7. All prices are inclusive of any applicable taxes. I reserve the right to amend my prices from time to time, but any change to my prices will not affect any bookings which have already been confirmed and paid for.


6. YOUR OBLIGATIONS

6.1. You must provide me with all relevant and accurate information about your Dog by completing the Information Form. You must notify me as soon as reasonably practicable of any changes to the information provided in the Information Form.

6.2. You must provide me with the means to access your Dog at the agreed pick-up location, including any keys or access codes that may be required, and you will ensure that I am able to collect and return your Dog at the agreed times.

6.3. You must ensure that you provide suitable leads, harnesses and collars for your Dog for all walks.

6.4. You will ensure that your Dog is fit and ready to attend the walk in the booked slot. You understand that your Dog should not eat a full meal for at least 2 hours before walking.

6.5. You confirm that your Dog is microchipped in accordance with the applicable microchipping regulations.

6.6. You accept and agree that your Dog will come into contact with other dogs and animals whilst I perform the Services.

6.7. In the event that urgent or emergency veterinary treatment is required during a walk, I will contact you as soon as reasonably practicable. If you cannot be contacted, you authorise me to consent to any necessary emergency treatment from an appropriate veterinary surgery, and you agree to reimburse me for any reasonable veterinary costs incurred.

6.8. You agree to provide proof of all current and up-to-date vaccinations in relation to your Dog upon request.

6.9. You agree to notify me prior to any booked walk if your Dog has become infected with any infectious or contagious disease or condition. You understand that, in those circumstances, I may choose to cancel the booking.

6.10. You agree and understand that I will not walk dangerous or aggressive dogs, and you warrant that your Dog has never displayed dangerous or harmful behaviour towards humans or other animals.

6.11. You agree and understand that, where your Dog is male and over the age of 12 months, my acceptance of the booking may be conditional upon your Dog being neutered.

6.12. You agree and understand that, where your Dog is female and over the age of 6 months, my acceptance of the booking may be conditional upon your Dog being spayed.

6.13. You consent to your Dog being photographed and filmed by me, and you understand that any such photographs or videos of your Dog may be used as part of promotional content in relation to the Services. You may withdraw this consent at any time by notifying me in writing.


7. LIABILITY

7.1. I will always take reasonable care in relation to equipment and toys provided to me by you, but I am not responsible for any accidentally lost, stolen or damaged equipment, save where caused by my negligence.

7.3. If I fail to perform the Services with reasonable care and skill, or otherwise breach this Agreement, I will be responsible for loss or damage you suffer that is a foreseeable result of my breach. I will not be liable for any loss or damage that was not foreseeable, or that was caused by your fault or the fault of any third party.

7.4. Subject to clause 7.5, my total aggregate liability to you under or in connection with this Agreement (howsoever arising) shall not exceed the amount payable under my public liability insurance policy in respect of the relevant event.

7.5. Nothing in this Agreement excludes or limits my liability for death or personal injury caused by my negligence, for fraud or fraudulent misrepresentation, for any breach of your statutory rights under the Consumer Rights Act 2015, or for any other liability which cannot lawfully be excluded or limited.


8. YOUR PERSONAL INFORMATION

8.1. In order to provide the Services to you, I will need to process your personal information.

8.2. I will process your personal information only in accordance with the UK General Data Protection Regulation, the Data Protection Act 2018 and all other applicable data protection laws. I am the data controller in respect of the personal information you provide to me.

8.3. Full details of how I collect, use, store and share your personal information, and of your rights in respect of that information, are set out in my privacy notice, a copy of which is available on request at ________.


9. COMPLAINTS AND DISPUTES

9.1. If you are dissatisfied with the Services in any way, please contact me to discuss the matter using the contact details listed above.

9.2. Alternative Dispute Resolution (ADR) is a process whereby an independent body assists with a dispute in order to resolve it without the need for court proceedings. If you are not satisfied with my handling of a complaint, you may wish to contact a suitable ADR provider.


10. VARIATION

10.1. No variation to this Agreement shall be effective unless it is made in writing and expressly agreed by both of us.


11. SEVERANCE

11.1. If any provision or part-provision of this Agreement is or becomes invalid, illegal or unenforceable, it shall be treated as deleted, but that deletion shall not affect the validity and enforceability of the remainder of this Agreement.


12. GOVERNING LAW AND JURISDICTION

12.1. This Agreement and any dispute or claim arising out of or in connection with it shall be governed by and construed in accordance with the law of England and Wales.

12.2. The courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim, save that nothing in this clause shall affect any statutory right you may have to bring proceedings in the courts of the part of the United Kingdom in which you are domiciled.


13. THIRD-PARTY RIGHTS

13.1. No one other than a party to this Agreement shall have any right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Agreement.
