Further to our previous conversations, I am pleased to write to confirm my invitation for you to come and stay at my home as an au pair and as a member of my family for the purpose of a cultural exchange.

As a member of the family, you will help with the care of my child:

I should make clear at the outset that this arrangement is intended to be a cultural exchange and is not an offer or contract of employment. It is a private, reciprocal arrangement between us as set out in the agreement below.

AU PAIR CULTURAL EXCHANGE AGREEMENT

1. THE PARTIES

1.1. Host Family

2. NATURE AND PURPOSE OF THE AGREEMENT

2.1. This Agreement confirms the arrangements for the Au Pair to come and live with the Host Family as a member of the family on a cultural exchange basis.

2.2. During the Term of this Agreement the Au Pair will be given the opportunity to gain experience caring for children and to develop their cultural, linguistic and social skills.

2.3. In return, the Au Pair will help the Host Family with light housework and childcare, as defined below.

2.6. The Au Pair confirms that they are aged 18 or over and not more than ________ years of age at the Commencement Date.

3. TERM OF AGREEMENT

3.1. This Agreement will commence on ________ when the Au Pair will move in with the Host Family (the "Commencement Date").

3.2. The Parties have agreed that the Au Pair will stay with the Host Family for a period of ________ months from the Commencement Date (the "Term").

3.3. The Agreement will terminate at the end of the Term unless extended in accordance with clause 3.4, or terminated earlier in accordance with clause 8.

3.4. The Term may be extended by mutual written agreement between the Host Family and the Au Pair, subject always to the Au Pair holding valid immigration permission to remain in the United Kingdom.

4. AU PAIR DUTIES AND ENTITLEMENTS

4.1. During the Term, the Au Pair will assist with general household tasks, light housework and childcare (the "Duties"), which will include:

4.2. The Au Pair must conduct themselves in a respectful and appropriate manner whilst carrying out their Duties and whilst living in the family home.

4.3. The Au Pair must not take part in any illegal or disreputable act or conduct during the course of this Agreement, including (but not limited to):

(a) fraud, theft or any dishonest act;

(b) any attempted or actual act of violence, or abusive or threatening behaviour towards people or property;

(c) being intoxicated through alcohol or drugs, or otherwise not sober, when caring for or looking after the child of the Host Family; or

(d) any irresponsible act or behaviour which, in the reasonable opinion of the Host Family, would put the child or the Host Family in danger or could result in injury.

4.4. The Au Pair will be treated as a member of the Host Family and will not be expected to have sole responsibility for the running of the household, nor sole and unsupervised charge of the child save as expressly agreed between the Parties.

4.5. The Au Pair shall undertake the Duties for a maximum of ________ hours per week. These hours shall be flexible and subject to change as is reasonably necessary for the family life and activities of the Parties.

4.6. During the Term, the Host Family shall provide the Au Pair with weekly pocket money of £________ (________), payable each week in arrears.

4.7. The weekly pocket money shall be for the Au Pair to spend as they please and they shall not be expected to spend it in the fulfilment of their obligations under this Agreement.

4.8. The Au Pair will be reimbursed by the Host Family for any reasonable expenses incurred directly as a result of performing their obligations under this Agreement, including travel costs or costs incurred purchasing items for the child. Receipts should always be provided.

4.9. The Au Pair shall be entitled to ________ full days off each week on which they will not undertake any Duties. These days shall be discussed and arranged between the Parties to fit around their respective schedules, including any study obligations of the Au Pair.

4.10. The Au Pair will be given ________ full days of paid free time during the Term. During these days the Au Pair will not be required to carry out any Duties for the Host Family. The free time can be scheduled in consultation and agreement with the Host Family on reasonable notice.

4.11. The Au Pair may be invited to accompany the Host Family on family holidays taken during the Term. Where the Au Pair accompanies the Host Family, the Host Family shall cover all reasonable costs and expenses for the Au Pair, and the Au Pair shall continue to receive their pocket money and to enjoy proportionate free time and days off during such holiday.

5. LIVING ARRANGEMENTS

5.1. During the Term the Au Pair shall be resident at the home of the Host Family at their address stated above, and the Au Pair will not be charged any rent or board. The Parties acknowledge that the Au Pair occupies the accommodation as a member of the Host Family's household and not as a tenant, and that no tenancy or licence creating security of tenure is created by this Agreement.

5.2. The Au Pair shall be provided with their own private bedroom in the family home, furnished with the following:

5.3. The Au Pair should keep their bedroom and any bathroom provided for their use in a habitable, appropriate and clean state.

6. HOST FAMILY OBLIGATIONS

6.1. The Host Family shall treat the Au Pair as a member of the family and shall make every effort to help the Au Pair settle in and feel welcome and comfortable in the family home.

6.2. The Host Family shall provide the Au Pair with their main meals each day, which the Au Pair will usually take together with the family.

6.3. The Host Family shall provide the Au Pair with reasonable free time to enable them to pursue their studies, attend language classes and undertake their own cultural, social and leisure activities.

6.4. The Host Family shall ensure that the Duties required of the Au Pair are reasonable, suitable and consistent with the terms of this Agreement, and shall not require the Au Pair to undertake any tasks which are unsafe or inappropriate.

6.5. The Host Family shall take all reasonably practicable steps to ensure the health, safety and welfare of the Au Pair while in their home and shall maintain appropriate household and public liability insurance.

7. CHILDREN, SAFEGUARDING AND DATA PROTECTION

7.1. The Host Family confirms that they are entitled to make arrangements for the care of the child named in this Agreement.

7.2. The Au Pair agrees to provide, on request, a criminal record or police certificate from their country of origin and/or to consent to such checks as the Host Family may reasonably require for the safeguarding of the child, in accordance with applicable law.

7.3. Each Party shall comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 in respect of any personal data of the other Party or of the child processed in connection with this Agreement. Personal data shall be processed only for the purposes of, and for the duration of, this arrangement, kept secure, and not disclosed to third parties save as required by law.

8. IMMIGRATION AND HEALTHCARE

8.1. It is a condition of this Agreement that the Au Pair secures and provides proof of valid immigration permission to enter and remain in the United Kingdom which permits the activities contemplated by this Agreement. The Au Pair must promptly notify the Host Family of any change to their immigration status.

8.2. The Au Pair must have appropriate arrangements in place to ensure access to healthcare during their stay, including payment of the Immigration Health Surcharge (where applicable) as part of their visa application and/or adequate medical and travel insurance.

8.3. The Host Family will reimburse the reasonable costs of a successful visa application to the Au Pair upon receipt of proof of the visa and the receipts evidencing the costs incurred, up to a maximum of £________.

8.4. If this Agreement terminates by reason of the Au Pair's material breach of any term or obligation within ________ weeks of the Commencement Date, the Au Pair must repay the reimbursed cost of the visa to the Host Family within 4 weeks of the termination date.

8.5. If, for any reason, the Au Pair's immigration permission is terminated, expires or is revoked, this Agreement shall terminate immediately.

9. TERMINATION

9.1. Either Party may terminate this Agreement at any time during the Term by giving no less than ________ weeks' written notice to the other.

9.2. The Host Family may terminate this Agreement with immediate effect if the Au Pair commits a serious or persistent breach of this Agreement, including (without limitation) any conduct described in clause 4.3, or where the welfare of the child reasonably requires it.

9.3. Upon termination, the Host Family shall pay any pocket money and reimbursable expenses accrued up to the date of termination, but shall not be required to pay any further pocket money thereafter.

9.4. Upon termination, the Au Pair shall vacate the family home, returning any keys, equipment or other property of the Host Family, within a reasonable period agreed between the Parties.

10. SEVERANCE

If any provision or part-provision of this Agreement is or becomes invalid or unenforceable, it shall be deemed deleted, but such deletion shall not affect the validity and enforceability of the remainder of the Agreement.

11. VARIATION

No variation of this Agreement shall be effective unless it is made in writing and signed by each Party.

12. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the Parties and supersedes all prior discussions, correspondence and arrangements between them relating to its subject matter.

13. RIGHTS OF THIRD PARTIES

A person who is not a party to this Agreement shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Agreement.

14. WRITTEN NOTICE

Any notice given under this Agreement may be given by letter, email or text or messaging service to the address or contact details notified by each Party to the other.

15. GOVERNING LAW

This Agreement and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter shall be governed by and construed in accordance with the law of England and Wales.

16. JURISDICTION

Each of the Parties irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this Agreement or its subject matter.
