Re: Demand for Replacement of Defective Product Pursuant to Republic Act No. 7394 (Consumer Act of the Philippines) and the Civil Code of the Philippines
Dear ________,
§ 1. Purpose of This Letter. I respectfully write, in my capacity as consumer-purchaser, to formally demand the replacement of the product described below (the “Product”), which I purchased from you on ________ for the total consideration of ________, as evidenced by Official Receipt/Sales Invoice No. ________:

§ 2. Description of the Defect. Upon use and inspection, I found the Product to be unfit for its ordinary or intended purpose and not in conformity with the warranties extended to me, by reason of the following defect/s, which became apparent on ________:

§ 4. Demand. Accordingly, I hereby formally DEMAND that you replace the defective Product with a brand-new unit of the same kind, quality, and specifications, free of any additional charge, within ________ from your receipt of this letter. Should replacement no longer be feasible, I reserve my right to demand the rescission of the sale and a full refund of the purchase price, together with damages and costs, pursuant to law.

Should I fail to receive a satisfactory response and concrete corrective action within ________ from the date of this letter, I shall be constrained, without further notice, to pursue all remedies available to me under the law, including but not limited to the filing of a formal complaint with the Department of Trade and Industry pursuant to Republic Act No. 7394, and/or the institution of the appropriate civil or criminal action for the recovery of a full refund, damages, attorney’s fees, and costs of suit. This letter is sent without prejudice to and with full reservation of all my rights under Philippine law.
