Re: Notice of Cancellation of Membership Agreement


Dear Sir/Madam:

This letter serves as my formal written notice, pursuant to the terms of the Membership Agreement and the applicable provisions of the Civil Code of the Philippines (Republic Act No. 386), to terminate and cancel my membership with ________ (the "Company"), effective as hereinafter stated.

§ 1. Membership Details. The relevant particulars of the membership subject of this cancellation are as follows:

§ 2. Effective Date of Cancellation. The cancellation of my membership shall take effect on ________, in accordance with the notice period stipulated under our Agreement. From and after the said effective date, no further charges, fees, dues, or assessments of any kind shall be billed to, charged against, or collected from my account, and any standing authorization for automatic debit or recurring charges is hereby withdrawn and revoked.

§ 3. Cancellation Fee. In compliance with the provisions of the Agreement, I have tendered and enclosed herewith the cancellation/termination fee in the amount of ________ Pesos (₱________), payable to the Company. Should no such fee be lawfully due, kindly disregard this paragraph and so advise me in writing.

§ 4. Refund of Balance. Pursuant to Articles 1278 to 1290 (on compensation) and Article 1232 (on payment) of the Civil Code of the Philippines, kindly refund to me any unused, prepaid, or outstanding balance on my membership in the amount of ________ Pesos (₱________), within ________ days from receipt of this notice. Payment of the said refund may be made through the following mode and details:

§ 7. Confirmation Requested. Kindly confirm in writing, within ________ days from your receipt hereof, that my membership has been duly cancelled, that no further charges shall be made to my account, and that the refund (if any) shall be processed in accordance with § 4 above.

§ 8. Reservation of Rights. This notice is made without prejudice to, and with full reservation of, all my rights and remedies under the Agreement and under Philippine law. Nothing herein shall be construed as a waiver of any claim, defense, or cause of action available to me.
