RE: NOTICE OF TERMINATION OF EMPLOYMENT BY REASON OF REDUNDANCY
This letter is issued to you pursuant to the terms of your contract of employment dated ________ and in accordance with the provisions of the Labour Act, Cap L1, Laws of the Federation of Nigeria 2004 (the “Labour Act”).
§1. Background and Decision
1.1 Further to our meeting held on ________, we regret to inform you that, following careful consideration and in consequence of organisational restructuring and operational changes within the Company, the management has resolved to terminate your employment by reason of redundancy.
1.2 For the purposes of this letter, “redundancy” bears the meaning ascribed to it under Section 20(3) of the Labour Act, namely an involuntary and permanent loss of employment caused by an excess of manpower.
1.3 We confirm that this decision is in no way connected with your conduct, capability or job performance, but is solely a measure adopted to ensure the continued stability and viability of the business.
§2. Effective Date and Notice
2.1 Your employment with the Company shall terminate with effect from ________ (the “Termination Date”).
2.2 We confirm that we have complied with the notice requirements stipulated in your contract of employment and under Section 11 of the Labour Act. Where the Company elects to make payment in lieu of notice, a sum equal to your remuneration for the unexpired portion of the notice period, being ________, shall be paid to you.
§3. Reason for Termination
3.1 As stated above, the termination is not occasioned by any act or omission on your part, but arises from the following reason(s):

3.2 In selecting employees for redundancy, the Company has had due regard to the principle of “last in, first out” (subject to the relative merit and skill of affected employees) in accordance with Section 20(1)(c) of the Labour Act and any applicable agreement.
§4. Redundancy and Severance Entitlements
4.1 In recognition of your service and in accordance with applicable law and the terms of your employment, the Company shall pay to you a redundancy/severance sum of \u20a6________ (________).
4.2 In addition, the Company shall pay all outstanding entitlements accrued up to the Termination Date, including salary up to the Termination Date, payment for any accrued but unused annual leave, and any other benefits properly due under your contract of employment.
4.3 The said payments shall be made to you on or before the Termination Date, less any lawful deductions for tax under the Personal Income Tax Act, pension contributions under the Pension Reform Act 2014, and any sums lawfully owed by you to the Company.
§5. Return of Company Property

6.1 Notwithstanding the termination of your employment, your obligations of confidentiality, non-disclosure and protection of the Company’s proprietary and confidential information, as set out in your contract of employment, shall survive and continue to bind you.
§7. Data Protection
7.1 The Company shall continue to process and retain your personal data in accordance with the Nigeria Data Protection Act 2023 and solely for lawful purposes, including the discharge of its statutory, regulatory and record-keeping obligations.
§8. Reference and Certificate of Service
8.1 Upon request, the Company shall furnish you with a certificate of service in accordance with Section 8 of the Labour Act, specifying the period of your employment and the capacity in which you were employed.
