RE: FORMAL COMPLAINT AND DEMAND FOR ABATEMENT OF NUISANCE EMANATING FROM YOUR PROPERTY AT ________

§1. Introduction

  1. I am the lawful occupier of the property situate at and known as ________ ("my Property"), and I am your immediate/adjoining neighbour.
  2. You are the owner and/or occupier of the property situate at and known as ________ ("your Property").
  3. I write to formally complain about the manner in which your Property is being used, which constitutes a private nuisance unlawfully interfering with my right to the quiet and reasonable enjoyment of my Property.

§2. Particulars of the Nuisance

  1. There has, on a continuing and recurring basis, emanated from your Property excessive and unreasonable noise, the particulars of which are as follows: ________.
  2. The said noise and disturbance occur principally during the following times: ________.
  3. This nuisance has persisted continuously and/or intermittently for the following period: ________.

§3. Effect of the Nuisance

§4. Legal Basis

  1. The acts complained of constitute a private nuisance under the common law of tort as applicable in Nigeria, being an unlawful and unreasonable interference with the use and enjoyment of my Property.
  2. I expressly reserve all my rights and remedies, including the right to seek an injunction, an order for abatement, and damages before a court of competent jurisdiction, and to lodge a complaint with the appropriate regulatory and law enforcement authorities.

§5. Demand

  1. I have hitherto endured this disturbance with patience; however, it has now become unbearable and continues to interfere with my reasonable enjoyment of my Property.
  2. I therefore demand that you forthwith, and in any event within ________ of the date of this letter, take all necessary steps to abate the said nuisance and to ensure that it does not recur.
