RE: TEMPORARY SUSPENSION OF RENT PAYMENT IN RESPECT OF THE PREMISES SITUATE AT ________

§1. Introduction. I write in my capacity as the Landlord/Lessor under the Tenancy Agreement dated ________ ("the Tenancy Agreement") made between myself and you, the Tenant/Lessee, in respect of the premises situate at and known as ________ ("the Premises").

§2. Suspension of Rent. I hereby notify you that, of my own volition and as a concession to you, I have agreed to suspend your obligation to pay rent in respect of the Premises for the period of ________, being the rent which fell due, or which would otherwise fall due, on ________, in the sum of ________ ("the Suspended Rent").

§3. Duration. This suspension shall take effect from ________ and shall remain in force until ________, after which your obligation to pay rent under the Tenancy Agreement shall automatically resume in full without further notice.

§4. Nature and Effect of the Suspension.

  1. This suspension is a temporary forbearance only and does not amount to a permanent waiver, reduction, abatement, release or cancellation of the Suspended Rent or of any rent thereafter accruing, save to the extent (if any) expressly stated herein.
  2. The forbearance of the Landlord in respect of the Suspended Rent shall not operate as a waiver of any present or future breach by the Tenant of any term, covenant or condition of the Tenancy Agreement.
  3. Whether the Suspended Rent is permanently waived or merely deferred and payable upon expiry of the suspension period shall be as indicated here: ________.

§6. Resumption of Payment. Upon the expiration of the suspension period stated in §3, the Tenant shall resume payment of rent in accordance with the Tenancy Agreement on the next due date, namely ________, and any deferred sums (if applicable under §4) shall be paid in the manner set out at ________.

§7. Governing Law. This arrangement and the Tenancy Agreement shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, and in particular the applicable tenancy legislation of ________, and any dispute arising herefrom shall be subject to the jurisdiction of the appropriate courts or tenancy tribunal of the said State.

§8. Acceptance. Kindly indicate your acceptance of this arrangement by executing the acknowledgement and acceptance below and returning a copy to me.
