RE: NOTICE OF CHANGE OF OWNERSHIP OF THE PROPERTY KNOWN AS ________ ("the Property")
§1. INTRODUCTION
1.1. I, ________ of ________ ("the Outgoing Landlord"), being the erstwhile owner and landlord of the Property situate at and known as ________, which you presently occupy as tenant pursuant to a Tenancy/Lease Agreement dated ________ ("the Tenancy Agreement"), hereby give you formal notice of the matters set out below.
1.2. This notice is issued in accordance with the terms of the Tenancy Agreement and the applicable tenancy laws in force in ________, including (where applicable) the relevant State Tenancy Law and the principles of the common law of Nigeria.
§2. NOTICE OF CHANGE OF OWNERSHIP
2.1. Please be informed that ownership of and legal title to the Property has been transferred by way of sale, pursuant to a Deed of Assignment dated ________, to ________ of ________ ("the New Landlord").
2.2. By virtue of the said transfer, and in accordance with established principles of land and property law in Nigeria, the New Landlord has, with effect from ________ ("the Effective Date"), succeeded to all the rights, interests, benefits and obligations of the Outgoing Landlord under the Tenancy Agreement, including the right to receive rent and the reversion of the Property.
§3. PAYMENT OF RENT
3.1. With effect from the Effective Date, all rent and other sums due and payable under the Tenancy Agreement shall be paid to the New Landlord, ________, and not to the Outgoing Landlord.
3.2. All such payments shall be made into the account or by the method designated by the New Landlord, particulars of which are as follows: ________.
3.3. You are hereby advised that any payment of rent made to the Outgoing Landlord after the Effective Date shall not discharge your obligations under the Tenancy Agreement.
§4. CONTINUITY OF TENANCY AND SECURITY DEPOSIT
4.2. Your caution/security deposit in the sum of ________ has been duly transferred to and is now held by the New Landlord, who shall be responsible for its refund or application in accordance with the Tenancy Agreement.
§5. PRESERVATION OF RIGHTS AND OBLIGATIONS
5.1. Nothing in this notice shall be construed as affecting, diminishing or prejudicing any of your rights, interests or obligations as tenant under the Tenancy Agreement or under the applicable law, all of which remain fully preserved.
5.2. Your right to quiet enjoyment of the Property for the unexpired residue of your tenancy is hereby affirmed.
