§ 1. INTRODUCTION
1.1 This Remote Work Policy (the “Policy”) sets out the rules, practices, and procedures governing employees of the Company who are permitted to perform their duties remotely.
1.3 This Policy is made in accordance with the Labour Act (Cap L1, Laws of the Federation of Nigeria 2004), the Nigeria Data Protection Act 2023, and all other applicable laws of the Federal Republic of Nigeria, and forms part of the terms and conditions of employment of the affected employees.
1.4 By signing the acknowledgement at the end of this Policy, You confirm that You have read and understood this Policy and agree to be bound by its terms.
§ 2. SCOPE
2.1 This Policy applies to all employees of the Company who, by their contract of employment or by reason of prevailing circumstances, are permitted to work remotely.
2.2 This Policy operates in conjunction with, and does not derogate from, the employee’s contract of employment, the Employee Handbook, and the Company’s other policies and procedures.
§ 3. ELIGIBILITY
3.1 Any employee may work remotely where remote work is expressly stipulated under their contract of employment.
3.2 An employee may otherwise be considered for remote work where:

§ 4. DURATION
4.1 An employee may request to work remotely on a temporary basis for a maximum period of ________.

§ 5. COMPLIANCE WITH COMPANY POLICY
5.1 All employees working remotely are required to comply with all rules, policies, guidelines, and codes of conduct of the Company as contained in the Employee Handbook and any other instrument issued by the Company from time to time.
§ 6. REMOTE WORK SCHEDULE
6.1 Every employee working remotely shall observe the following work schedule:

6.2 The employee shall remain available and reachable during the scheduled hours and shall promptly attend all meetings and calls convened by the Company.
§ 7. DESIGNATED WORK AREA
7.1 Every remote worker shall perform their duties from a suitable and convenient workspace outside the office premises. To ensure maximum productivity while working remotely, the employee shall:
(a) choose a quiet and organised work environment free from distraction;
(b) maintain a reliable internet connection adequate for the performance of their duties;
(c) adhere to the remote work schedule in relation to attendance, working hours, and meetings; and
(d) devote their full time and attention to their work during working hours.
7.2 The management may, upon reasonable notice, inspect the employee’s work environment to ascertain its suitability for work. Save where any loss or injury is attributable to the negligence of the Company, the Company shall not be liable for any environmental hazard, loss, or injury occurring at the remote work location.
§ 8. WORK TOOLS AND EQUIPMENT
8.1 The Company shall provide the necessary work tools and equipment required for the performance of the employee’s duties upon request.
8.2 All equipment provided by the Company shall remain the exclusive property of the Company and shall be kept in good condition. In particular, employees shall:

8.3 Company tools and equipment shall be used solely for work-related assignments and projects and shall not be used for personal purposes.
8.4 Upon the cessation of remote work or the termination of employment for any reason, the employee shall forthwith return all Company tools, equipment, documents, and property in their possession or control.
§ 9. DATA PROTECTION AND CONFIDENTIALITY
9.1 The employee shall, at all times while working remotely, protect the confidentiality and security of the Company’s information, trade secrets, and the personal data of the Company, its employees, customers, and third parties in accordance with the Nigeria Data Protection Act 2023 and the Company’s data protection policies.
9.2 The employee shall not disclose, copy, transmit, or store Company information on any unauthorised device, network, or platform, and shall take all reasonable measures to prevent unauthorised access to Company systems and data.
9.3 The obligations under this clause shall survive the termination of the employee’s employment and the cessation of remote work.
§ 10. COMPENSATION AND BENEFITS
10.1 Remote workers are entitled to the same remuneration and benefits as office-based employees, including bonuses, promotion and salary increments, annual leave, sick leave, and other benefits provided under their contract of employment, in accordance with the Labour Act.
10.2 In particular, employees working remotely shall be entitled to the following benefits:

§ 11. RIGHTS
11.1 Every employee working remotely shall enjoy the same rights as office-based staff, including the right to receive any applicable overtime pay, the right to make requests and complaints, and the right to attend conferences and training.
11.2 Remote workers shall be permitted to attend all training, conferences, and meetings made available to office-based workers, and the Company shall notify all remote workers of any impending or ongoing training or conference.
§ 12. COMPLIANCE AND ENFORCEMENT
12.1 Every employee working remotely shall comply with the provisions of this Policy. Non-compliance shall attract disciplinary measures, which may include, depending on the circumstances of each case and subject to the employee’s contract of employment and the Labour Act, dismissal.
12.2 An employee who wishes to make a formal complaint about any matter arising from this Policy, or to challenge compliance with this Policy, shall report the matter in the following manner:

§ 13. MODIFICATION OF THIS POLICY
13.1 The Company reserves the right to modify and revise this Policy from time to time. Where any fundamental change is made, employees shall be duly notified of such change.
§ 14. DISPUTE RESOLUTION
14.1 Where any dispute arises out of or in connection with this Policy, the parties shall first endeavour to resolve the dispute amicably through good-faith negotiation.
14.2 Any dispute which cannot be amicably resolved within ________ shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Mediation Act 2023 or any statutory re-enactment or modification thereof.
14.3 The arbitral tribunal shall consist of ________ arbitrator(s) appointed in the following manner:

16.1 If any provision of this Policy is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from this Policy and the remaining provisions shall continue in full force and effect.
§ 17. ENTIRE AGREEMENT
17.1 This Policy, together with the employee’s contract of employment and the Employee Handbook, constitutes the entire understanding between the Company and the employee in relation to remote work and supersedes all prior agreements, representations, and understandings on the subject matter.
