第1条（本契約の特定）
当社（以下「通知人」といいます。）は、貴社との間で、________付で________（以下「本契約」といいます。）を締結し、本契約に基づき、通知人は貴社に対し下記の商品（以下「本件商品」といいます。）の引渡しを求める権利を有しております。

通知人は、本契約に基づく代金________を________のとおり既に履行済みです。
第2条（債務不履行の事実）
しかしながら、本契約所定の引渡期限である________を経過したにもかかわらず、貴社は下記のとおり本件商品の引渡債務を履行しておらず、債務不履行（民法第412条以下）の状態にあります。
