Re: Formal Written Warning — Workplace Harassment / Sexual Harassment

Dear ________,

§ 1. Purpose of this Letter. This letter constitutes a formal written warning issued by ________ (the “Employer”) in respect of your conduct in the workplace. The Employer has determined, following investigation, that you have engaged in behaviour amounting to workplace harassment, and in particular sexual harassment, directed toward ________.

§ 2. Applicable Standards. The Employer is required to ensure a workplace free of harassment and violence. Your conduct, as described below, contravenes the Employer’s ________ (the “Policy”) and is contrary to the applicable occupational health and safety and human rights legislation of the Province of ________, including without limitation the ________ and the ________, and, where applicable, the Canada Labour Code, R.S.C. 1985, c. L-2, and the Canadian Human Rights Act, R.S.C. 1985, c. H-6.

§ 3. Particulars of the Conduct. The conduct giving rise to this warning, which was the subject of our prior discussion with you on ________, includes the following:

§ 4. Prior Notice. You have previously been notified of the unacceptable nature of this conduct and have acknowledged that such behaviour is not tolerated in the workplace. Notwithstanding that notice, the conduct has continued, which indicates that the seriousness of this matter has not been fully appreciated.

§ 5. Expectations Going Forward. The Employer requires that, effective immediately, you: (a) cease all conduct of the nature described above; (b) comply fully with the Policy and all applicable law; (c) refrain from any reprisal, retaliation, or adverse conduct toward any person who has participated in or is connected to this matter; and (d) treat all colleagues with dignity and respect.

§ 7. Support and Inquiries. Should you wish to discuss this letter, require clarification regarding the Employer’s expectations, or seek information regarding available support resources, please contact ________.

§ 8. Record. A copy of this letter will be retained in your personnel file. This letter does not constitute the entirety of the Employer’s rights and is issued without prejudice to, and in full reservation of, all rights and remedies available to the Employer at law and under your terms of employment.
