RE: CEASE AND DESIST DEMAND


Dear ________:

§ 2. Description of the Offending Conduct. Beginning on or about ________, and continuing thereafter, you have engaged in the following conduct directed at or affecting me (collectively, the “Offending Conduct”):

§ 3. Supporting Documentation. In support of this demand, I refer you to the documents and other materials enclosed with or attached to this letter, described as follows:

§ 4. Harm Suffered. As a direct and foreseeable result of the Offending Conduct, I have suffered loss, damage, and harm, including, without limitation, the following (as applicable):

  1. physical harm or personal injury;
  2. substantial harm to my business and business interests;
  3. substantial harm to my reputation;
  4. substantial harm to my personal character;
  5. mental distress and emotional suffering; and
  6. other harm or damages, namely: ________.

§ 5. Demand. I hereby demand that you, and any person acting on your behalf or under your direction, immediately and permanently:

  1. cease and desist from the Offending Conduct and from any further conduct of a similar nature;
  2. refrain from any direct or indirect contact or communication with me, except through legal counsel; and
  3. preserve all records, documents, communications, and electronic data relating to the Offending Conduct, as these may constitute relevant evidence in any future proceeding.

§ 6. Deadline for Compliance. You must confirm in writing your compliance with this demand on or before ________. Written confirmation should be directed to me at the address set out above.

§ 7. Consequences of Non-Compliance. If you fail to comply with this demand by the date specified above, I intend to pursue all available legal remedies against you without further notice, including, but not limited to, the commencement of civil proceedings in the courts of ________ seeking injunctive relief, damages, interest, and costs, and any other relief available to me under applicable federal, provincial, or territorial law. This letter may be tendered as evidence of your conduct and of your having received notice of my demand.
