Re: Complaint About Faulty Product — Request for Remedy Under the Australian Consumer Law

§ 1. Background

1.1. On ________, I purchased the following goods from you ("the Product") for the price of $________:

1.2. The Product was supplied to me as a "consumer" within the meaning of section 3 of the Australian Consumer Law, being Schedule 2 to the Competition and Consumer Act 2010 (Cth) ("the ACL").

§ 2. The Fault

2.1. I am not satisfied with the quality of the Product. The defect or problem is described as follows:

§ 3. Breach of Consumer Guarantees

3.2. By reason of the matters set out in § 2 above, the Product fails to meet one or more of these consumer guarantees, and accordingly there has been a failure to comply with a consumer guarantee within the meaning of section 259 of the ACL.

§ 4. Remedy Sought

4.1. Pursuant to section 259 of the ACL, where the failure to comply with a consumer guarantee is not a major failure, I am entitled to require you, at your cost, to remedy the failure within a reasonable time.

4.2. Accordingly, I require you to repair the Product, at your cost and within a reasonable time, so that it complies with the consumer guarantees.

§ 5. Response Required

5.1. Please respond using the contact details set out above to confirm that you are complying with the above request and to advise the arrangements for repair of the Product.

5.2. If I do not receive a satisfactory response within seven (7) days of the date of this letter, I will have no alternative but to take further action to enforce my rights. This may include, but is not limited to, lodging a complaint with the relevant State or Territory consumer protection agency (such as ________), referring the matter to the Australian Competition and Consumer Commission, and/or commencing proceedings in the appropriate court or tribunal for recovery of a refund, damages and costs.

5.3. A copy of the proof of purchase is enclosed for your reference.
