Re: Termination of Your Employment by Reason of Genuine Redundancy

We refer to your employment with ________ (the Company) in the position of ________, and to the consultation that has recently taken place between you and the Company.

This letter confirms the outcome of a recent review of the Company's operational requirements and the decision that has been made as a consequence of that review.

1. Background and operational changes

1.1 As you are aware, the Company has recently encountered significant operational and commercial circumstances, including the following:

1.2 As a result of these circumstances, the Company has made the decision that it no longer requires the job performed by you to be performed by anyone because of changes in the operational requirements of the Company's enterprise. This decision relates to the position of ________.

2. Termination of employment

2.1 Regrettably, and for the reasons set out above, your employment with the Company is being terminated by reason of redundancy.

2.2 The Company has given genuine consideration to whether it would be reasonable in all the circumstances to redeploy you within the Company or an associated entity, and unfortunately no suitable alternative position is available.

2.3 We wish to make it clear that this termination is in no way a reflection on the quality of your work or your conduct. You have been a valued member of our team and this decision relates solely to the operational requirements of the Company.

3. Notice of termination

3.1 In accordance with section 117 of the FW Act and the terms of your employment, you are entitled to the following period of notice of termination: ________.

4. Redundancy pay

4.1 Your period of continuous service with the Company is ________.

5. Final pay and entitlements

5.2 Where you have been paid annual leave in advance, any amount of leave that you owe to the Company may be deducted from your final pay to the extent permitted by section 324 of the FW Act and your contract of employment.

5.3 Your final payments may be subject to taxation in accordance with applicable laws administered by the Australian Taxation Office. Tax will be withheld as required by law, and an Employment Termination Payment summary will be issued to you where applicable.

5.4 Your final pay will be paid into your nominated bank account, and final superannuation guarantee contributions will be paid to your nominated superannuation fund in accordance with the Superannuation Guarantee (Administration) Act 1992 (Cth).

6. Return of Company property and confidentiality

6.1 On or before your last day of employment, please return to the Company all Company property in your possession or control, including but not limited to ________.

6.2 Your obligations of confidentiality and any post-employment obligations under your contract of employment continue to apply after the termination of your employment.

7. Statement of service and references

7.1 The Company will provide you with a statement of service on request, and will provide a reference in accordance with its usual practices.
