§ 2. The Lease. Tenant occupies the Premises pursuant to a written residential lease agreement dated ________ (the “Lease”), with a term commencing on ________ and scheduled to terminate on ________. The current monthly rent under the Lease is ________, and Tenant previously deposited a security deposit in the amount of ________.
§ 3. Notice of Intent to Vacate. Tenant hereby gives notice that Tenant is unable to remain in possession of the Premises for the full balance of the Lease term, and intends to vacate and surrender the Premises on ________ (the “Vacate Date”). Tenant acknowledges that, unless the Lease is assigned or otherwise terminated by mutual agreement, Tenant may remain liable for rent and other obligations through the end of the Lease term as permitted by applicable law, subject to the landlord’s duty to mitigate damages where required by law.
§ 4. Request to Assign or Sublet to Replacement Tenant. Tenant has identified a qualified prospective replacement tenant (the “Proposed Replacement Tenant”) who is willing to assume the remainder of the Lease term on the same terms and conditions. The Proposed Replacement Tenant will contact you directly regarding application, credit and background screening, and execution of any assignment, sublease, or new lease documentation you reasonably require. Tenant requests your written consent to such assignment or sublease, which, pursuant to the Lease and applicable law, shall not be unreasonably withheld, conditioned, or delayed.
