RE: FORMAL DEMAND TO CEASE AND DESIST HARASSMENT


Dear ________,

I, ________ (the “Sender”), am writing to you, ________ (the “Recipient”), to demand that you immediately and permanently CEASE AND DESIST from engaging in the harassing conduct described in this letter. This letter constitutes formal written notice of such demand.

§ 1. Documented Pattern of Harassing Conduct. Beginning on or about ________ and continuing through the date of this letter, you have engaged in a repeated course of conduct directed at me that serves no legitimate purpose and that has caused me substantial alarm, annoyance, and distress. Such conduct includes, but is not limited to, the following:

§ 2. Effect of Your Conduct. Your actions are unwanted, unwelcome, and unwarranted, and they infringe upon my legal right to be free from harassment, intimidation, and intrusion upon my peace and privacy. As a direct and proximate result of your conduct, I have suffered harm including, but not limited to, the following (where applicable):

(a) Physical harm or injury;

(b) Substantial harm to my business or livelihood;

(c) Substantial harm to my professional reputation;

(d) Substantial harm to my personal character;

(e) Emotional distress, anxiety, and apprehension; and

(f) Additional harm as follows:

§ 4. Written Confirmation. I request that you confirm in writing, within ________ days of your receipt of this letter, your agreement to comply with the demands set forth herein. Such confirmation may be directed to me at the address or email address listed above.

§ 5. Consequences of Non-Compliance. Please be advised that this is a serious legal matter. If you fail to comply with this demand and continue to engage in the harassing activities described above, I will be forced to pursue any and all available legal remedies against you, including, but not limited to: (a) seeking a temporary restraining order, civil harassment restraining order, protective order, or order of protection from a court of competent jurisdiction in ________; (b) filing a civil action for monetary damages, including compensatory, statutory, and punitive damages and attorneys’ fees and costs as permitted by applicable law; and (c) reporting your conduct to the appropriate law enforcement authorities for criminal investigation and prosecution under applicable federal and state anti-harassment, anti-stalking, and cyberstalking statutes.

§ 6. Preservation of Evidence. A copy of this letter, together with the enclosed supporting documentation, will be retained and may be used as evidence of notice and of the pattern of conduct described herein in any future administrative, civil, or criminal proceeding.
