10. Additional standards applicable to videos, audio and photographs
10.1. Where the Site provides services enabling you to upload or share photographs, video or other multimedia content, the content standards in clause 9 apply, together with the following additional standards:
10.1.a. you must bring any multimedia uploaded or shared on the Site that contains restricted material to our immediate attention;
10.1.b. restricted material includes material containing content that would constitute, or would be punishable as, a criminal offence of:
- terrorism;
- sexual abuse;
- the sexual exploitation of children;
- the making, possession or distribution of indecent images of children;
- racism; or
- xenophobia;
restricted material also includes any material that is unclassified, unclassifiable, or rated (or suitable to be rated) for persons over 18, or which might impair the physical, mental or moral development of persons under 18;
10.1.c. you must not upload to, or otherwise share on, the Site any multimedia containing material likely to incite violence or hatred against any person or group of persons;
10.1.d. you must not upload to, or otherwise share on, the Site any multimedia that advertises:
- cigarettes or other tobacco products;
- electronic cigarettes or electronic cigarette refill containers; or
- any prescription-only medicine;
10.1.e. you may only upload to, or otherwise share on, the Site any multimedia that advertises alcohol if:
- the product is not specifically aimed at persons under the age of 18; and
- the content does not encourage the immoderate consumption of alcohol;
10.1.f. any multimedia you upload to, or otherwise share on, the Site that contains advertising must not:
- prejudice respect for human dignity;
- include or promote discrimination based on sex, racial or ethnic origin, nationality, religion or belief, disability, age or sexual orientation;
- encourage behaviour prejudicial to health or safety;
- encourage behaviour grossly prejudicial to the protection of the environment;
- cause physical, mental or moral detriment to persons under the age of 18;
- directly exhort such persons to purchase or rent goods or services in a manner which exploits their inexperience or credulity;
- directly encourage such persons to persuade their parents or others to purchase or rent goods or services;
- exploit the trust of such persons in parents, teachers or others; or
- unreasonably show such persons in dangerous situations; and
10.1.g. any multimedia uploaded to, or otherwise shared on, the Site for advertising purposes must, so far as is reasonably practicable, be readily recognisable as an advertisement and must not convey any message subliminally.
11. Breaches of this policy
11.1. Where we determine, in our reasonable discretion, that there has been a breach of this policy, we may take such action as we deem appropriate, including (without limitation):
- issuing you with a formal warning;
- immediate, temporary or permanent withdrawal of your right to access and use the Site;
- immediate, temporary or permanent removal of any content uploaded or contributed by you;
- issuing legal proceedings against you for reimbursement of all costs on an indemnity basis (including, without limitation, reasonable administrative and legal costs) resulting from the breach; and/or
- disclosing such information to law enforcement authorities, regulators or other relevant agencies as we reasonably consider necessary or as required by law.
11.2. The responses described in clause 11.1 are not exhaustive, and we may take any other action we reasonably deem appropriate.
11.3. We exclude our liability for all action we may take in response to breaches of this policy.
12. Limitation of liability
