DEED OF DONATION INTER VIVOS


KNOW ALL MEN BY THESE PRESENTS:

This Deed of Donation Inter Vivos (the "Deed") is made and executed by and between:

________, Filipino, of legal age, ________, with residence and postal address at ________, hereinafter referred to as the "DONOR";

________, Filipino, of legal age, ________, with residence and postal address at ________, hereinafter referred to as the "DONEE".


WITNESSETH: That -

§ 2. Subject of the Donation. For and in consideration of the foregoing, the DONOR, by way of Donation Inter Vivos, hereby FREELY, VOLUNTARILY, and IRREVOCABLY GIVES, TRANSFERS, and CONVEYS unto the DONEE the following:

Cash in the sum of ________ Philippine Pesos (₱________).

The said cash donation shall be delivered to, or deposited in, the following account of the DONEE:

The above-stated amount shall be delivered immediately upon the execution of this Deed.

§ 3. Reservation for Support. In compliance with Article 750 of the Civil Code of the Philippines, the DONOR hereby declares that he/she has reserved, in full ownership or in usufruct, sufficient means for his/her support and that of all relatives who, at the time of the acceptance of this donation, are by law entitled to be supported by the DONOR.

§ 4. No Intent to Defraud Creditors. The DONOR manifests that this donation is not made with intent to defraud his/her creditors, and that he/she has reserved sufficient funds and property for the payment of all his/her existing debts and obligations, conformably with Article 759 of the Civil Code of the Philippines.

§ 6. Taxes and Fees. The donor's tax due on this donation, pursuant to the National Internal Revenue Code of 1997, as amended, together with documentary stamp taxes, notarial fees, and all other charges incidental to this Deed, shall be for the account of ________, unless the parties otherwise agree in writing.

§ 7. Binding Effect. This Deed shall be binding upon, and inure to the benefit of, the parties and their respective heirs, executors, administrators, successors, and assigns.

§ 8. Governing Law. This Deed shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
