SHORT-TERM RESIDENTIAL TENANCY AGREEMENT

THIS SHORT-TERM RESIDENTIAL TENANCY AGREEMENT is made this ________

BETWEEN

________, an individual of the following address:

(hereinafter referred to as the "Landlord", which expression shall, where the context so admits, include his/her heirs, personal representatives, successors-in-title and assigns) of the first part;

AND

________, of the following address:

________

(hereinafter referred to as the "Guest", which expression shall, where the context so admits, include his/her heirs, personal representatives, successors-in-title and permitted assigns) of the second part.

The Landlord and the Guest are hereinafter together referred to as the "Parties" and individually as a "Party".


RECITALS

A. The Landlord is the beneficial owner of, and is otherwise lawfully entitled to grant possession of, the residential property more particularly described in this Agreement (the "Property").

B. The Guest desires to occupy the Property on a short-term residential basis, and the Landlord has agreed to grant the Guest a licence/short-term tenancy to occupy the Property, subject to the terms and conditions hereinafter contained.

C. This Agreement is made having regard to the relevant tenancy laws applicable in the State in which the Property is situate, including (where applicable) the Tenancy Law of ________.

NOW IN CONSIDERATION of the rent reserved and the covenants and conditions herein contained, the Parties hereby agree as follows:


§1. AGREEMENT TO LET

1.1. Subject to the terms and conditions of this Agreement, the Landlord agrees to let, and the Guest agrees to take, the following residential property (the "Property"):

§2. USE OF THE PROPERTY

2.1. The Guest shall use the Property for private residential purposes only, and no part of the Property shall be used to carry on any business, profession or trade of any kind, PROVIDED ALWAYS that:

(I) the Guest shall not receive any paying guests, clients or customers;

(II) no act of the Guest shall constitute a nuisance to the occupiers of adjoining or neighbouring properties;

(III) no act of the Guest shall significantly increase the wear and tear of the Property; and

(IV) the Property or any part thereof shall not be used for any illegal, unlawful or immoral purpose.


§3. TERM

3.1. This Agreement shall commence on ________ (the "Commencement Date") and shall expire on ________ (the "Expiration Date"), unless sooner determined in accordance with this Agreement.

3.2. On the Expiration Date, the Guest shall vacate and deliver up possession of the Property unless the Parties mutually agree in writing to an extension or renewal of the term.


§4. RENT

4.1. The Guest shall pay to the Landlord the sum of \u20a6________ (________) per week (the "Rent"). The Rent shall be due and payable in advance on ________ of each week.

4.3. The Landlord shall issue a written receipt for every payment of Rent or other sums received under this Agreement.


§5. SECURITY DEPOSIT

5.1. Upon execution of this Agreement, the Guest shall deposit with the Landlord the sum of \u20a6________ (________) as security against any damage which may be caused to the Property during the term (the "Security Deposit").

5.2. The Security Deposit shall be paid by the method described in §4 above.

5.3. The Landlord shall, within ________ days after the Expiration Date and after deduction of any sums lawfully due, refund the balance of the Security Deposit to the Guest. The Security Deposit shall not be treated as, or applied in lieu of, Rent.


§6. SERVICE CHARGE

6.1. The Guest agrees to pay a service charge of \u20a6________ (________) weekly.

§7. TELEPHONE AND INTERNET

The Property shall be equipped with a telephone and wireless internet (Wi-Fi), the cost of which is included in the Rent. The Guest acknowledges that, while internet services will be provided, the quality and stability of the connection may vary, and the Landlord shall not be liable for any interruption arising from causes beyond the Landlord's reasonable control.


§8. UTILITIES

The Landlord shall be responsible for the payment of electricity, water, environmental sanitation and other utility charges as agreed by the Parties, save where otherwise expressly stated as follows: ________.


§9. DATA PROTECTION

9.1. The Parties acknowledge that personal data exchanged under this Agreement shall be processed in accordance with the Nigeria Data Protection Act 2023.

9.2. Each Party shall process the personal data of the other only for the purpose of performing this Agreement, shall keep such data secure and confidential, and shall not disclose it to any third party save as required by law or as necessary to give effect to this Agreement.


§10. ACCESS

10.1. Upon payment of the Security Deposit and the first instalment of Rent, the Landlord shall grant the Guest access to the Property on the Commencement Date.

10.2. Where the Guest desires to host visitors at the Property, the Guest shall notify the Landlord in writing or by email of the number of visitors. The Guest assumes full responsibility for the conduct of any person invited onto the Property, and any breach of this Agreement or harm caused by such persons shall be the responsibility of the Guest.

10.3. The Landlord reserves the right to refuse access to any visitor who poses a security threat to the Landlord, the Property or other occupiers.


§11. EXCESSIVE NOISE

The Guest shall ensure that neither the Guest nor any visitor engages in disruptive or unlawful behaviour, including excessive noise, disturbance of neighbours, or breach of any applicable byelaw or ordinance. Persistent breach of this provision may, upon reasonable notice, result in determination of the tenancy and recovery of possession in accordance with applicable law.


§12. INSURANCE

Save in respect of loss or injury arising from the Landlord's own negligence or default, the Landlord shall not be liable to the Guest or any visitor for damage, loss or injury resulting from fire, flood or any act of God. The Guest is advised to obtain appropriate insurance to protect the Guest, the Guest's visitors and their respective belongings.


§13. RENTAL RULES

13.1. The Guest agrees to comply with the following rules at all times during the authorised stay at the Property (the "Rental Rules"):

(I) Occupancy: the maximum number of persons permitted to occupy the Property is ________;

(II) Noise: the Guest shall observe quiet hours so as to avoid disturbance to neighbours and other occupiers;

(III) Smoking: smoking is not permitted within the Property save in any designated area approved by the Landlord;

(IV) Damages: the Guest is responsible for any damage caused to the Property during the stay and may be charged accordingly;

(V) Security: the Guest shall keep all doors and windows secured and shall be responsible for his/her own security at the Property;

(VI) Conduct: the Guest shall behave responsibly and respectfully towards the Property and its occupiers;

(VII) Cleaning: the Guest shall dispose of refuse properly and leave the Property in a tidy condition;

(VIII) Compliance: the Guest shall comply with all applicable laws and regulations during the stay.

13.2. The Guest shall ensure that all visitors and licensees abide by the Rental Rules at all times during their presence at the Property.


§14. RENEWAL

The Landlord may, upon the written request of the Guest given prior to the Expiration Date, extend the tenancy for a further term as agreed by the Parties, subject to a revised Rent and to the execution of a fresh agreement or addendum.


§15. MAINTENANCE AND REPAIR

15.1. The Guest and persons authorised by the Guest shall at all times keep the Property and its appurtenances in good sanitary condition and repair, fair wear and tear excepted, during the term and any renewal thereof.

15.2. If, at the end of the term, any fixtures or fittings are found to be missing or not kept in proper condition, the Guest shall repair, replace, or pay the reasonable cost of replacement thereof.


§16. MAINTENANCE OF ORDER

The Guest agrees:

(I) not to make or permit any loud or improper noise or otherwise cause nuisance to other residents in the area; and

(II) not at any time during the term to do or permit any act which may constitute a nuisance or annoyance to neighbours or occupiers of adjoining premises.


§17. CONDITION OF THE PROPERTY

The Guest acknowledges that the Property is in good order, repair and condition and is located in a clean and safe environment.


§18. QUIET ENJOYMENT

The Landlord covenants that, provided the Guest pays the Rent and observes all the covenants and conditions contained in this Agreement, the Guest shall during the term peaceably hold and enjoy the Property without interruption by the Landlord or any person lawfully claiming through or under the Landlord.


§19. INSPECTION

The Landlord may, at all reasonable times during the term and any renewal thereof and upon giving the Guest reasonable prior notice (save in an emergency), enter the Property for the purpose of inspection and/or carrying out repairs.


§20. SUBLETTING AND ASSIGNMENT

The Guest shall not sublet, assign, part with or share possession of the Property or any part thereof with any third party without the prior written consent of the Landlord.


§21. ALTERATIONS AND IMPROVEMENTS

21.1. The Guest shall not, without the prior written consent of the Landlord:

(I) paint or significantly alter the appearance of the Property;

(II) place or permit any placard, notice, poster or sign for advertising or other purpose inside or outside the Property;

(III) install any plant, equipment, machinery or apparatus;

(IV) demolish, rebuild or restructure any part of the Property; or

(V) construct, alter or make any improvement to the building.

21.2. Where the Landlord approves any alteration, addition or improvement to be undertaken by contractors, such contractors must first be approved by the Landlord.


§22. PETS POLICY

The Guest and the Guest's visitors shall comply with the following:

(I) pets must be properly supervised at all times;

(II) pets must be kept on a leash or within a carrier while in common areas;

(III) the Guest must clean up after pets both indoors and outdoors;

(IV) pets are not permitted on furniture or bedding unless a pet-specific cover is used;

(V) any damage caused by pets shall be the responsibility of the Guest and may attract additional charges; and

(VI) pets must be properly vaccinated and free of fleas and ticks, failing which the Guest may be charged for pest-control services.


§23. PARKING

The Landlord shall provide a designated parking space for the Guest where available. The Guest shall ensure that any vehicle parked on the Property is properly insured and licensed. The Guest shall not permit any unauthorised vehicle to park on the Property, and the Landlord shall not be liable for any loss, theft or damage to any vehicle or its contents parked on the Property.


§24. NOTICES


§25. DISPUTE RESOLUTION

25.1. In the event of any dispute, difference or disagreement arising between the Parties in connection with or arising out of this Agreement, the Parties shall first endeavour to resolve the dispute amicably through mutual negotiation.

25.2. Where the dispute cannot be resolved amicably within a reasonable time, the matter shall be referred to mediation, and if still unresolved, shall be determined in accordance with the laws of the Federal Republic of Nigeria, and the courts of ________ shall have jurisdiction.


§26. ILLEGAL USE

Neither the Guest nor any visitor shall use the Property for any illegal purpose, including but not limited to drug use, prostitution, or any other activity prohibited by law. Upon proven breach of this clause, and subject to applicable law, the tenancy may be determined and the Guest required to vacate the Property.


§27. KEYS AND LOCKS

The Guest shall not alter, replace or add any lock to the Property without the prior written consent of the Landlord. Where the Guest installs additional locks with the Landlord's consent, such locks shall remain on the Property at the Expiration Date, and the Guest shall deliver up all keys on the Expiration Date.


§28. TERMINATION

28.1. The Guest shall not terminate this Agreement prior to the Expiration Date, save where the Landlord breaches a fundamental term of this Agreement. Where the Guest vacates or abandons the Property before the Expiration Date, the Guest shall remain liable for any unpaid Rent or charges until the natural determination of the tenancy.

28.2. The Landlord may terminate this Agreement before the Expiration Date provided that the Landlord gives the Guest not less than ________' notice, and otherwise complies with the applicable tenancy law where recovery of possession is required.

28.3. On the determination of the tenancy, the Guest shall quit, surrender and deliver up the Property together with all appurtenances in the same condition as at the Commencement Date, fair wear and tear excepted.


§29. SURRENDER OF POSSESSION

29.1. On the expiration of the term and any renewal thereof, the Guest shall quit, surrender and deliver up possession of the Property together with all appurtenances in the same condition as at the Commencement Date, fair wear and tear excepted.

29.2. Any items left behind by the Guest shall be held for a reasonable period, after which they may be disposed of. The Landlord shall not be responsible for such items, and any item unclaimed within six (6) months shall be deemed forfeited by the Guest.


§30. HOLDING OVER

30.1. If the Guest fails to vacate the Property at the end of the term or otherwise continues in occupation, a month-to-month tenancy shall arise on the same terms and conditions of this Agreement so far as applicable, until the Parties mutually agree in writing to extend or renew the tenancy for a fixed term.

30.2. Where a month-to-month tenancy arises, the Guest shall give the Landlord not less than thirty (30) days' written notice of intention to surrender the Property, and the Landlord may determine the tenancy by giving the Guest written notice in accordance with applicable law.


§31. INDEMNITY


§32. BREACH

32.1. If the Guest breaches any fundamental provision of this Agreement, the Landlord may, upon issuance of the requisite statutory notice and recovery of possession in accordance with applicable law, re-enter the Property and recover possession thereof.

32.2. The Guest shall pay damages for any loss, damage or cost incurred by the Landlord as a consequence of such breach and shall indemnify the Landlord against all actions, claims, liabilities, costs and expenses arising therefrom.


§33. ABANDONMENT

If at any time during the term the Guest abandons the Property or any part thereof before the Expiration Date, the Landlord shall be entitled to re-enter and re-let the Property, and the Guest shall remain liable for any outstanding Rent and other sums due and payable.


§34. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria and the applicable tenancy law of the State in which the Property is situate.


§35. MISCELLANEOUS

35.1. Variation: No variation of this Agreement shall be binding unless made in writing and signed by both Parties. No delay or omission to exercise any right shall be construed as a waiver thereof.

35.2. Assignment: No Party shall assign any of its rights, obligations or duties under this Agreement without the prior written consent of the other Party.

35.3. Headings: Headings are for convenience only and shall not affect the construction of this Agreement.

35.4. Counterparts: This Agreement may be executed in counterparts, each of which shall constitute an original and all of which together shall constitute one instrument.

35.5. Entire Agreement: This Agreement, together with any addendum, constitutes the entire agreement between the Parties and supersedes any prior written or oral agreement.

35.6. Enurement: This Agreement shall enure to the benefit of and be binding on the Parties and their respective heirs, personal representatives, successors and permitted assigns.

35.7. Cumulative Rights: The rights of the Parties under this Agreement are cumulative and not exclusive, save as otherwise provided by law.

35.8. Waiver: Any term of this Agreement may be waived only in writing by the Party entitled to its benefit, and no delay in exercising any right shall operate as a waiver.

35.9. Severability: If any provision of this Agreement is held unenforceable, the remaining provisions shall continue in full force and effect.

35.10. Further Assurance: The Parties shall execute and deliver all such further documents and take all such further actions as may be necessary or incidental to give effect to this Agreement.
