RE: Offer to Renew Residential Tenancy Agreement – ________

Dear ________,

I am writing in relation to your residential tenancy of the premises situated at ________ (Premises), occupied under the residential tenancy agreement dated ________ (Tenancy Agreement).

This letter is issued in the State/Territory of ________ and is given in accordance with the residential tenancy legislation applicable in that jurisdiction (for example, the Residential Tenancies Act 2010 (NSW), Residential Tenancies Act 1997 (Vic), Residential Tenancies and Rooming Accommodation Act 2008 (Qld), or the equivalent legislation in your State or Territory) (the Act). This letter is an offer to enter into a new fixed-term agreement and does not, of itself, terminate or vary your existing rights under the Act.

1. Expiry of current term

The current fixed term of your Tenancy Agreement is due to expire on ________. You have been a valued tenant, and I am pleased to offer you the opportunity to renew your tenancy from that date, on the terms set out below.

2. Proposed rent

The rent currently payable is $________ (________) per ________. Under the renewed agreement, the rent would increase to $________ (________) per ________, representing an increase of $________ (________).

The proposed rent increase is to take effect from ________ and is given subject to, and in compliance with, the minimum notice period and frequency restrictions prescribed by the Act. Nothing in this letter limits your right to seek a review of any rent increase by the relevant tribunal where the Act provides such a right.

In addition to the proposed rent, I propose that the following variations would apply to the terms of the renewed agreement:

In that event, your existing rights under the Act, including the right to continue on a periodic (continuing) tenancy where the Act so provides, are not affected by this letter.
