FEDERAL WORK-STUDY STUDENT EMPLOYMENT AGREEMENT
This Federal Work-Study Student Employment Agreement (the "Agreement") is entered into as of ________, by and between the institution and the student identified below, in connection with the Federal Work-Study Program authorized under Title IV, Part C of the Higher Education Act of 1965, as amended (42 U.S.C. § 2751 et seq.), and the regulations promulgated thereunder at 34 C.F.R. Part 675.

§ 1. ELIGIBILITY
1.1. To qualify for student employment under this Agreement, the student must be registered and maintain enrollment as a full-time student in good academic standing. Full-time status is equivalent to ________ credits.
1.2. The student must have been awarded Federal Work-Study funds, as determined by the Office of Financial Aid based on demonstrated financial need pursuant to 34 C.F.R. § 675.9, in order to participate in the student employment program.
1.3. The student must remain a citizen or eligible noncitizen of the United States and must satisfy all general Title IV eligibility requirements throughout the term of employment. Loss of eligibility shall automatically terminate this Agreement.
§ 2. POLICY ON STUDENT WORK
2.1. The student is limited to ________ hours per week of employment during the academic year, and in no event may total earnings exceed the Federal Work-Study award amount stated above.
2.2. The student may not work during scheduled class time. If a class is canceled in advance, the student may work during that period only if the instructor verifies the cancellation in writing.
2.3. The student may hold only one position through this program at any given time.
2.4. Individuals serving as a resident advisor or in any other live-in capacity for which financial or housing benefits are received are not eligible for student employment under this Agreement.
2.5. The student will be supervised for the duration of all work performed.
2.6. The student shall comply with all departmental rules and policies, including limitations on cell phone usage during work hours.
2.7. The student must be punctual and ready to perform assigned duties at the scheduled start of each shift.
2.8. The student is expected to dress appropriately for the position in which they are working.
2.9. The student is entitled to a break of ________ for every ________ hours worked, consistent with applicable federal and state wage-and-hour laws, including the Fair Labor Standards Act (29 U.S.C. § 201 et seq.) and the laws of the State of ________.
2.10. If the student does not perform to the standards established by their immediate supervisor, the student shall be subject to a progressive disciplinary policy, up to and including termination of employment.
2.11. A student who wishes to terminate this work-study Agreement early must notify both their immediate supervisor and the Office of Financial Aid in writing.
2.12. The student shall abide by any additional policy documents provided to them, including, without limitation, the Work-Study Handbook or similar materials, which are incorporated herein by reference.
§ 3. EMPLOYMENT DOCUMENTS
3.1. The student is required to submit all employment paperwork at the commencement of employment. Such documents shall include a federal Form I-9 (Employment Eligibility Verification) together with the required identification documents pursuant to 8 U.S.C. § 1324a, and a Form W-4 for tax withholding pursuant to 26 U.S.C. § 3402.
3.2. Additional paperwork may include a student employment application, a parental or guardian release for minors under the age of eighteen (18), and supplementary agreements such as a confidentiality agreement where required.
§ 4. PAYROLL
4.1. The student is not required to submit a direct deposit authorization but is encouraged to do so to expedite payroll processing.
4.2. The student will be paid biweekly for all hours actually worked, at the hourly rate set forth above, in accordance with the institution's payroll schedule.
4.3. The student may review payroll information online through their student account.
4.4. Wages earned under this program are subject to all applicable federal, state, and local tax withholding requirements.
§ 5. AT-WILL NATURE OF EMPLOYMENT
5.2. This Agreement does not guarantee employment for any specified period and shall not entitle the student to continued employment beyond the term stated above or beyond the period during which the student remains eligible.
§ 6. EQUAL OPPORTUNITY AND NONDISCRIMINATION
§ 7. GOVERNING LAW
7.1. This Agreement shall be governed by and construed in accordance with applicable federal law and the laws of the State of ________, without regard to its conflict-of-laws principles. Any dispute arising under this Agreement shall be subject to the exclusive jurisdiction of the courts located in ________.
§ 8. ENTIRE AGREEMENT; SEVERABILITY; AMENDMENT
8.1. This Agreement, together with the policy documents incorporated herein by reference, constitutes the entire understanding between the parties with respect to its subject matter and supersedes all prior or contemporaneous understandings, whether written or oral.
8.2. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
8.3. This Agreement may be amended only by a written instrument signed by both parties or by the institution's issuance of updated program policies.
§ 9. ACKNOWLEDGMENT
9.1. By signing below, the student acknowledges that they have read, understood, and agree to comply with all of the terms, policies, and conditions set forth in this Student Employment Agreement.
9.2. The student further acknowledges that failure to abide by these terms may result in disciplinary action, up to and including termination of employment.
9.3. The student acknowledges that this Agreement does not guarantee employment for any specified period and may be terminated by either party in accordance with the policies described herein and applicable law.
