RE: Demand to Cease Commercial Electronic Mail and Remove Me From Your Email List — Opt-Out Notice Under the CAN-SPAM Act (15 U.S.C. § 7701 et seq.)
To Whom It May Concern:
§ 2. Identification of Recipient Address. The electronic mail address to be removed from all of your marketing, promotional, and commercial mailing lists is: ________. Any additional addresses or identifiers to be removed are: ________.
§ 3. Revocation of Consent. Although I may previously have provided authorization for you to send me commercial or marketing electronic mail, I hereby withdraw that authorization in full and no longer consent to receive any such communications from your company.
§ 4. Prior Opt-Out Attempts. I have previously attempted to unsubscribe by activating the “Unsubscribe” or similar opt-out mechanism contained within your messages on or about ________. Notwithstanding those attempts, I have continued to receive commercial electronic mail from you, which I believe constitutes a violation of 15 U.S.C. § 7704(a)(4), requiring that opt-out requests be honored within ten (10) business days.
§ 5. Frequency and Disruption. I currently receive commercial electronic mail from you at an approximate frequency of ________. The volume and frequency of these messages have been sufficient to cause a material disruption to me, and I object to their continued receipt.
§ 7. Confirmation Requested. Please provide written confirmation that this request has been processed by replying to the contact information set forth above on or before ________.
§ 8. Reservation of Rights. Nothing in this letter shall constitute a waiver of any of my rights or remedies, all of which are expressly reserved. Should you fail to comply with this demand within the period prescribed by law, I reserve the right to pursue all available remedies, including reporting the violation to the Federal Trade Commission and the Office of the Attorney General of the State of ________, and to seek any other relief available under applicable federal and state law.
