§ 1. Purpose of this Letter

1.2. The property to which this letter relates is situate at:

§ 2. Particulars of the Tenancy

2.1. I occupied the above property under a residential tenancy commencing on ________ and ending on ________.

2.2. At the commencement of the tenancy I paid to you a tenancy deposit in the sum of ________ (________) Euro, held as security against any rent arrears, damage to the property beyond normal wear and tear, outstanding utility charges and any breach of the tenancy agreement.

§ 3. Confirmation of Compliance with Tenant Obligations

3.1. Rent. I paid the agreed rent in full for each month of my occupancy on or before the date upon which it fell due, and there are no rent arrears outstanding.

3.2. Utilities. There are no outstanding sums owing in respect of any utility charges. To the best of my knowledge and belief, all financial obligations in respect of heating, electricity, gas and any other services have been discharged in full.

3.3. Condition of the Property. Throughout the tenancy I took all reasonable care of the property. The property was returned to you in good condition at the end of the tenancy, save for normal wear and tear within the meaning of the Residential Tenancies Act 2004 and the following matters which I bring to your attention:

3.4. Notice of Termination. Prior to vacating the property I served upon you valid notice of termination of ________ (________) weeks, in accordance with the notice period prescribed by the Residential Tenancies Act 2004 (as amended).

§ 4. Sum Requested

4.1. Having regard to the circumstances set out above, and having allowed for the matters referred to at § 3.3, I request the return of the deposit in the sum of ________ (________) Euro, which I believe to be a fair and equitable amount in light of the condition of the property and the discharge of all my obligations under the tenancy.

§ 5. Time for Payment

5.1. As I vacated the property on ________, the return of my deposit is now due and overdue. I respectfully request that you take steps to remedy this matter without further delay.

5.2. In the event that the deposit is not returned to me within ________ (________) days of the date of this letter, I reserve the right, without further notice to you, to refer the matter to the Residential Tenancies Board (RTB) for dispute resolution pursuant to Part 6 of the Residential Tenancies Act 2004, and/or to pursue such other legal recourse as may be available to me for the lawful recovery of the deposit, together with any interest, costs and expenses arising.
